'APPEAL WILL BE TAKEN ON TAXES REFUND Association Will Carry Fight to Supreme Court of State. Appeal from Circuit Judge , Arthur C. Van Duyn's' ruling at Greenfield Saturday on the Marion county horizontal tax refund case,will be taken to the state supreme court by the Indiana Taxpayers’ Association Harry Miese, secretary, anonunced today. At the same time, County Commisisoners George Snider and Dow W. Vorhies announced they will sanction the association's appeal. Van Duyn’s ruling, which released the county from refunding a larger part of the revenue collected under the tax ten years ago, affects more than 15,000 taxpayers, and provides that less than one-tenth of the approximated $8,000,000 be refunded. Willis C. Nusbaum, attorney for Miesse, said a motion for anew trial will be filed before Van Duyn within a week. The association will make every effort to curb the payment of numerous erroneous claims and will take steps to have all claims revised, Nusbaum stated. Miesse pointed out that six months is the time limit for the appeal, and in event Van Duyn declined to grant anew trial, the appeal will be perfected. GUARD POSTED AS JURY PROBES FEUD KILLINGS —* Armed Men on Duty at Salem in Fear of Attack by Families. By United Press SALEM, Ind„ Jan. 5.—A guard of armed men was thrown around Salem today as the Washington county grand jury met to investigate the recent outbreak of the Gibson-Spurlock feud. The guard was set up to allay fears that members of both families might descend from the hills and interfere with the investigation. The fight between the families started years ago in the hill country of Kentucky and Tennessee, was renewed more than a week ago when Patton Gibson, leader of his dan, was shot to death, allegedly by the Spurlocks. John and Plea- Spurlock are | charged with the murder and held ; here. Four of the Gibson brothers, sons j of 'Patton, came to the jail determined to settle with the Spurlocks in the manner of their clans. In a shootding that followed Otis Gibson was killed and Gilfred was.' captured. Dan and Alonzo remain lugitives. UNITED PRESS OPENS NEW CAPITOL SERVICE Full Time Leased Wires Connect Congress With Nation. By l tilled Press WASHINGTON. Jan. 5. The United Press Association today i opened a leased wire printer circuit connecting the house and senate press galleries with its Washington bureau. It is the first circuit of its kind to be opened at the Capitol. This additional circuit gives the United Press the most advanced mechanical facilities for reporting the activities of congress, providing full-time leased wire service from both houses direct into the Washington bureau, where copy is relayed to the general wire system. Latest model silent type telegraph printers have been installed for the Capitol circuit. Morse telegraph loops and direct telephones connecting with the United Press bureau's private switchboard provide supplementary facilities. FACES GAMINGCHARGE! Police today said they had brok.ni : up a juvenile Monte Carlo when they raided a confectionery operated by David Deal, at 1725 South ; East street Sunday night. The reason, police charge, was a slot machine dispensing as many as twenty-five pennies at once into a youngster's j hand. Deal is charged with operating a ! gaming device. ART ACORD KILLS SELF! Former Movie Star Suicide at Chihauhua City Hotel. It y United Press MEXICO CITY, Jan. 5.—A dispatch to Universal from Chihuahua City today said Art Acord, the former star of cowboy roles in motion pictures, had taken his own life at the Hotel Palaclo. FORTUNE GIVES HOSPITAL SITE Donates Land Needed for Veterans’ Institution. Deed for thirty acres in L .n | golf course, Riverside park, wr . on ! its way to Washington today, fol- ! lowing purchase of the tract by William Fortune, for the new | United States veterans hospital. Fortune’s donation was $16,335, the appraised price at which the site was sold by park, board. Bid was made by the Chamber of Commerce as trustee. Transfer of the tilte from the city to the federal government will take place at once. Bids for the first units of the hospital, to cost $500,000. will be received by the veterans’ bureau in Washington, Jan. 20, and contracts are expected to be awarded immediately after, giving employment to many men as soon as construction can be begun. An appropriation to treble the size of the hospital originally planned is ponding in cnogress. The hospital , is for treatment of general illness cl all veterans of military and naval service. Fortune, whose donation removed the last barrier to fulfillment of p ons for the hospital, has been chairman of the Indianapolis draper of American Red Cross since its inception in 1916. TEACHER IS FOUND Puzzling Disappearance Is Explained in Letter. B.n United Press WARSAW, Ind.. Jan. s.—Miss Virginia Bowman, North Webster mathematics teacher, whose whereabouts puzzled school authorities after she failed to return to her classroom following the holidays, was without a job today. Her place was taken by Miss Elizabeth Cook, daughter of the North Manchester school superintendent. A letter received by Principal John Bushong said Miss Bowman was at Warren would not return as she had made other plans. The letter did not explain her disappearance and authorities said there had been no differences between her and school authorities. Friends of Miss Bowman, however. said she left to avoid the attentions of a Michigan suitor for whom she had no interest. UNION STATION RENT LOWERED BY COURT t\ I. & W. Wins Suit in Cincinnati Rate Hearing. Decision of the United States circuit court in Cincinnati reduces the annual rent to be paid by the Cincinnati, Indianapolis & Western railroad for use of the Indianapolis Union railroad terminal facilities from sllC,tU3 to $85,000. The suit, filed by the Cincinnati, Indianapolis <&c Western railroad asked that the rent be reduced to $55,000. The litigation dates back to the merger of the Indianapolis. Decatur and Springfield railroad with the Cincinnati, Hamilton and Dayton to form C. 1.. &W. Both railroads : had contracts entitling them to use the union station for which each , was required to pay an annual rent | which the terminal authorities ! south to collect after the merger. REALTY PIONEER DEAD Charles S. Lewis, 76, Succumbs at Home in Brendenwood. Charles S. Lewis. 76, one of the oldest real estate operators in Marion county, died Sunday night at his heme in Brendenwood addition, which he had developed. Mr. Lewis was born in Huntington and came to Indianapolis in 1867. Surviving him are his widow. Mrs. Mary P. Lewis; four sons, Edward R. Lewis, Chicago, and Charles S. Lewis Jr., Montgomery S. Lewis and Philip C. Lewis of Indianapolis, and a sister. Mrs Mary L. Aughinbaugh. also of Indianapolis. Despite abnormal traffic due to almost springtime weather over the ; week-end, few accidents were reported to police, the sheriff and hospitals. Skidding on U. S. 31 two miles north of Broad Ripple early today an auto driven by Earl M. Jones, Kokomo, struck a utilities pole guy wire, crashing the pole to ftarth and carrying many wires down with it. Jones suffered minor injuries, was treated at city hospital and then went home. Three deputy sheriffs and a passenger were recovering today from injuries sustained when an emergency struck the concrete abutment of a safety zone Saturday night at Massachusetts avenue and St. Clair street. Carlton Boulden, 23, 1449 Southeastern avenue, taxi dSb driver, was in city hospital today with serious wounds on the head inflicted by three Negroes who slugged him at St. Clair and Meridian streets Sunday night, robbing him of SB. Cecil Rhodes, Negro, 1417 East Twenty-second street, was slugged by two Negroes and robbed of $lO as he and his wife stood at Massachusetts avenue and Tenth street early Sunday. Rhodes identified his assailants to police. Caught while trying to sell a ham, Eugene Ransom, 22, Negro, 716 North Senate avenue, was held today on a vagrancy charge under $2,000 bond, as a suspect in the theft Saturday of a part of a truck load of meat belonging to Swift & Cos., 723 Kentucky avenue. TARKINGTON TO SUBMIT TO OPERATION ON EYE Hoosier Author Hopes for Complete Restoration of Sight. Booth Tarkington, Indiana author, will return to Baltimore, Md., for another eye operation within the next few days. This, it is hoped, entirely will restore the sight of the writer’s left eye. His newest play, “Colonel Satan,” will have its Indianapolis premiere at the English theater tonight. Norman E. Perry, Columbia Club president, and P. C. Reilly, Indianapolis Athletic Club president, have urged their members to attend the performance as a gesture of respect and courtesy to Tarkington. Contest between the northern and southern divisions of the state has establishtd anew American Legion paidup membership record of 17,806 to start 1931, Ollie A. Davis, Tipton, department adjutant, announced today. Membership total at the start of this year is an increase of 3,999 over *1930. The southern division of the state signed 9,226 new members and the northern division 8,580 in the contest.
