UPTURN IN RAIL SHARES BOOSTS STOCK MARKET . * Railway Merger Prospects Add to Strength of Carrier Group.

Average of thirty industrials for Thursday was 171. up 1.11. Average of twenty rails was 95.86. up 2.09. Average of twenty utilities was 58.66. up .85 Average of fortv bonds was 93.27. up .44. By Unit'd Press B’l United Prcn* NEW YORK. Dec. 19— Railroad shares replaced industrials as stock market leaders today, rising 1 to more than 5 points in their best market In many weeks. Strength in the rails was brought on by rejuvenation of the consolidation idea for the eastern carriers. This rise helped industrials meet selling pressure for a time and they joined the upward movement again before the close. According to preliminary calculation by Dow Jones & Cos. the industrial average advanced 1.44, to 168.15 and the railroad average 3.78, to 99.64 Sales for the session totaled 2.270.350 shares compared with 3.290.370 shares Thursday. Market Closes Up The market generally closed higher, but there were a few weak spots in isolated groups. Auburn Auto wa one of these, selling off more than 4 points from the previous close and 8 points from its high of the day, mainly on profit-taking and absence of further short covering which had brought it up sensationally in Thursday’s session. Utilities did not make an impressive showing and the oils made only fractional advances. Transamerica eased fractionally on the day. New York Central led the rally in the railroad shares, rising more than 4 points. Baltimore & Ohio rose more than 6 points, Atlantic Coast. Line more than 5, Chesapeake Corporation nearly 4, Pennsylvania more than 8. Great Northern preferred 3 and Atchison nearly 4. Industrials Higher According to an analysis by Dow, .Tones <fe Cos., prospects are brighter for agreement, between representatives of eastern trunk lines on consolidation than at any time since the conferences began six years ago. United States Steel rose above 141 in the late afternoon and then fell back, closing at 140%, up 1% points net. Other industrial shares closed higher, with Vanadium up 3 points. Loew’s was strong in the amusements. Chemical shares, especially Air Reduction and Columbia Carbon, moved ahead. Call money held at 2 per cent. Closing the week at that level. Grains were steady to firm with oats and rye up more than a cent a bushel Cotton lost a few points.

In the Cotton Markets
(By Thomson & McKinnon) NEW YORK, Dec. 19.—The cotton market was handicapped by poor cables this morning and opened 10 or 12 points lower. Selling orders from Liverpool and pressure extended by local traders failed to reduce opening prices more than 1 or 2 points down on the day. For .some reason unknown to us the granting of additional funds to the farm board is considered bearish by some of the trade, or perhaps it was Legge’s statement that the secretary of agriculture should have more supervision over the trading on commodity exchanges. Whether it is wise or not we do not pretend to say, but certainly we see nothing in it to hring about lower prices. We are friendly to cotton because it can not be produced profitably at these prices, and would rather trust in an adjustment brought about by natural laws than to opinions based upon facts that have been known for a long time. Net results for the day were unimportant, prices fluctuating irregularly as the market apparently was attempting to recover its poise following its recent violent action. The strength in the rails was a particularly welcome development and appeared to be predicated upon the progress which is understood to have been made toward bringing the important eastern trunk lines together on merger plans of the eastern belt. The fact that the New York Central placed a large equipment order indicates that this carrier is looking forward optimistically and anticipating future requirements. Proving helpful to sentiment i probably second only in importance I to the recovery in stocks has been 1 the strength in the bond market. Financial observers claim that savings banks and insurance companies, attracted by the unusual yields, have placed large orders for high-grade bonds. Naturally, the possibility of a reaction and belated liquidation developing upon such a vigorous upturn in stocks makes for some slight hesitancy. However, based upon the deflated condition of brokers’ loans, the technical position of the market appears to be unusually strong. Sy United Press CHICAGO, Dec. 19.—A sharp, closing rally brought July wheat above the previous close on the Board of Trade today and it finished an erratic day with a moderate setback. Early liquidation had sent July to anew low for the season in sympathy with the new seasonal lows set at Liverpool and Winnipeg. The late buying was largely evening up and found offers limited, but selling on the bulge sent prices back with moderate losses. Short covering in com at the close boosted prices and that pit finished strong. Oats alone showed good strength and were firm. At the close wheat was Vs cent lower to % cent higher, July wheat % cent lower, corn was unchanged to % cent higher and oats were % to % cent higher. Provisions were sharply higher, shorts in December lard being caught in a squeeze. May com fell to anew low for the season and the other months were within a small fraction of the seasonal bottom early. The selling whs general on the weakness in w r heat and the heavy movement, especially to Missouri river points. At mid-session com prices were moderately up from the inside, showing Vs to *c lower, but there was no rallying power in evidence. Buying on resting- orders helped check the decline, but locals were bearish and pressed steadily. Cash prices were % to lVic lower. Receipts were 161 cars. Oats were firmer than the other grains and unchanged to Vsc lower at mid-morning, the change not being of any great significance. Trading was at a low ebb. Cash prices were V to %c higher. DELAY LIKELY ON BiLL FOR CLARK MEMORIAL Early Action on Funds Increase Improbable, Vestal Says. By United Press WASHINGTON, Dec. 20.—’There is little likelihood of early house action on the Vestal bill to provide an additional $750,000 for construction of a memorial to George Rogers Clark at Vincennes, Ind., Representative Luce (Rep., Mass.), chairman of the house library committee, said today. No committee hearings on the bill have been set for this session, Luce said. A similar measure passed by the senate also is before the committee. Considerable opposition has been Indicated. A bill appropriating $1,750,000 for the memorial was passed by the senate last session, but the figure was cut to $1,000,000 by the house. This measure later became a law. Representative Vestal (Rep., Ind.) then introduced the bill now pending which would increase the appropriation to the figure provided in the senate measure. BLAST WRECKS HOME: TWO CHILDREN KILLED Mother Seriously Injured When Explosion Lifts Roof From Building. By United Press CHICAGO, Dec. 20—Two children were killed and their mother seriously injured when an explosion, believed caused by gas, lifted the roof off a one-story brick building today and started a fire that destroyed all but the walls of the structure. Jerome Israelson, 5, and his brother Homer, 4, were burned to death. Their mother, Dora, was rescued by Jacob Kratisek, who was passing at the time of the explosion. Her injuries probably will prove fatal.

BUILD MURDER i CASE AGAINST SCARFACE AL Evidence Being Gathered in Effort to Send Capone to Chair? By United Press CHICAGO. Ijec. 20.—Evidence is being gathered against Scarface A1 Capone in an attempt to send him to the electric chair on a murder charge, it was learned today. Pressing the inquiry is Judge John H. Lyle of the municipal court. "Capone has become almost * mythical being, but he isn't a myth —he's a reptile,” Judge Lyle told the Chicago safety council Thursday night. “He deserves to die. and he will if we can help.” Judge Lyle disclosed that the vagrancy warrant he issued against Capone is intended to bring the Chicago gang leader into custody for efforts to indict him in connection with two gang murders. The state attorney's office confirmed Lyle's announcement. One assistant has been assigned to $;- semble evidence against Capone on which to charge him. when and it he is arrested, with slaying Joseph Howard, another gangster, in a saloon in 1924. The vagrancy warrant against Capone has not been served, it. was indicated, because of a desire to strengthen the chances of an indictment. The unsolved murder of Big Jim Colosimo. whose leadership in the underworld passed to Capone, also is being investigated. The state attorney’s office revealed the new hope o! trying Capone on murder charges was based on a belief that witnesses who would not talk in 1920 when Colosimo was slain and others who were mute in 1924 when Howard was killed would testify now.
