July 28—Eighty-year-old “Uncle Jake’’ Cubbage. grizzled head of a Blue Ridge mountain clan, began a fight for his life here today, assertedly confident he would be cleared of the murder of his 19-year-old grandson. Fred Cubbace. A Page county grand jury met here this morning to consider the case, and was expected before nightfall to return a murder indictment against the aged man. The trial is scheduled to begin in a few days If the indictment is returned, as expected. While “Uncle Jake’’ still professes j to believe the trial Jury will acquit him on his plea of self-defense, he j has lost some of the bravado displayed when he first was brought here for safekeeping after the shooting of the boy In Cubbage Hollow on June 8. k Enmities Stirred Up t He has been held in the Luray : SJail ever since, officials saying this pbction was taken “for the old man’s own good.” The shooting had stirred up old mountain enmities and authorities feared friends of the slain youth might start feud guns blazing again if the old man were released. The victim's widow, a Cubbage even before her marriage to young ) Fred, is bitter against the old man, •and is expected to testify against him. Children “See Ghosts” “Uncle Jake,” who at first said he shot the youth because "he wouldn’t ■behave himself,” has not told his side of the story to any one but his attorneys since he fired a shotgun into the boy’s body. The old man’s homestead has been under a cloud of superstition ever since the shooting, his three young children leaving after telling of . seeing ghosts in the yard at the spot where Fred Cubbage was killed. A force of twenty men from the state reformatory at Green Bay are quarrying the granite at Amberg, and others are engaged s finishing the product at Green Bay. Wls., July 28 —Discovery of a twelve-foot Indian canoe, split lengthwise, by William Koeppen, Walworth, proved to be a historic find dating back to the days of 1836 when the Potawatomi Indians departed from Lake Geneva. Koeppen was walking along the shore of ' the lake when he discovered the relic. It is believed that recent storms washed the canoe up from its resting place on the lake bottom. 7 HURT IN BUS CRASH Vehicle Crashes Into Telephone Tole at Michigan City. Lawrence Peters, 14-year-old newsboy. perched atop a giant Sagharo ' cactus today and defied the desert sun. Lawrence, who spends his time playing solitaire, told his ground crew he intended to stay up 100 hours. He passed his fifty-sixth hour at midnight, undaughted by weather ranging from 108 degrees of heat to a drenching rain and electrical storm. Grizzled prospectors glanced along the trail which had claimed the lives of many gold hunters and shook their heads. “The sun will get him yet,” they declared. Nation-wide attention has been attracted to the efforts of Indianapolis merchants to reduce the abuse of the privilege of returning mechandise, according to Merchants Association officials. Three committees, representing merchants in large retail centers, already have visited Indianapolis with the view of learning details of the plan which was put in effect May 15 by tfie Merchants Association, furnitm-e and shoe dealers. Thp committees plan to inaugurate similar movements in their cities. Tiie plan has had wide publicity in trade publications.
