STATE’S CLAIMS RULED PRIOR IN BANKCLOSINGS Ogden Opinion Regarded as Far-Reaching; Liability on Stock Argued. New chapters were being written into Indiana banking history today both by the supreme court and Attorney-General James M. Ogden. While the court heard an oral argument on the double liability of ’ stockholders in state banks, an opinion was given the state treasurer from the attorney-general's office setting out that the state is a preferred creditor in all banks in receivership or closed by the state banking department. The court case was appealed from Wells county, where the circuit court held that stockholders of the

Studebaker State bank at Bluff ton are not liable for double the amount of their stock. Previously settlements had been made in bank closures on the federal law, which holds stockholders for douftle indemnity. The case attracted a host of lawyers from throughout the state to the supreme court chamber. Frank Richards, assistant to Mrs. Grace Banta Reynolds, state treasurer, declared the attorney-general’s opinion giving the state prior claim to be “far reaching and revolutionary.” He expects the matter may be tested in the courts, and he will institute recovery suit, based on the preferred creditor theory, for the state funds in the Jay County State bank of Portland. When closed, by the staie banking department the bank had less than SIO,OOO of state funds on deposit, Richards said. Because there has been no court ruling in the matter, Richards said he would not attempt collection under the attorney-general’s ruling of the $98,809.48 in state funds on deposit with the State Savings and rrust bank in receivership here. This collection will be made on the $125,000 bond, he declared.

SNORT TROUSER FAD CONTINUES COLD Dartmouth Students Hail New Pants Style as ' ‘Triumph of Man.’ Bu United Press HANOVER, N. H.. May 15.—Rain today failed to halt the “shorts” fad and nearly 500 undergraduates wore abbreviated breeches to their classes today. Shorts enthusiasts did not need to wear shorts today to remain faithful. The Daily Dartmouth, student newspaper, said editorially that henceforth the abridged trousers should be worn “not on principle, but for comfort.” Thus, shorts would be considered in style only on warm days.
