March 15 Disposition of the Marion county horizontal tax refund case, involving $6,000,000, is probable within the next four \v<*-ks, .fudge Arthur C. VanDuyn of Hanucock circuit court indicated today. Attemp' . of attorney representing Marion county government officials to delay decision on the case, calling for a time extension for further litigation in addition to the eleven years the mater has been pending in court, proved unavailing when VanDuyn announced he would make a finding. Kale Hike Likely VanDuyn will determine whether Marion county must return the millions to 120.000 taxpayers, who paid the money into government coffers in 1919. 1920 and 1921. In event a refund Is ordered. Marion county taxpayers will lace a $1 boost In the 1921 tax rate, County Auditor Harry r Dunn has indicated. Oral arguments here Friday by batteries of attorneys reached fever heat at times in charges and coun-ter-charges that the long pending “tax baby’’ deliberately has been hurled from one court to another in dilatory proceedings. Finding Set Aside Marion Superior Judge James M. Leathers ruled three months ago tha tthe money must be refunded. A technicality brought further litigation in that Leather’s finding vas set aside for a changeof venue to Hancock county court. Seven plaintiffs in the action are Linn B. Millikan, John D. Ross of De Pauw university, judged the local contest. Members of the Hanover team were Daring Hudson, Paul Nicely, and John Rewiss. Negative debaters for Indiana Central included Herbert Montgomery, Glenn Johnson and Carl Barkley. CROSS-NATION RAIL SYSTEM BEING KNITTED ——— * Van Sweringen Brothers Are Nearer Goal Than Any Previous Attempts. Rv United Prcfie CLEVELAND, March 18.—Control of a trans-continental railway system by O. P. and M. J. Van Sweringen of Cleveland was a matter of conjecture among New York and Cleveland financial circles today. Observers believe the Van Sweringens, who already control an integral rail system from the eastern seaboard to Chicago and St. Louis, are much nearer that goal than any of the famous railroaders of the past. The Van Sweringens also have a working control of the trans-Missis-sippi system connecting the International Great Northern from Mexico at Laredo, Tex., and extending westward to Pueblo. Colo. Should the Van Sweringens make a satisfactory arrangement with the Western Pacific and their ownership of Missouri Pacific securities meet with favor, the complete control of the trans-United States system would be the result. The question naturally has arisen here as to whether the interstate commerce commission would approve a unified continental system. Polish Cabinet Resigns Rv United Press WARSAW.
