GARVIN PRAISED RY DRY LEAGUE ON RAID STAND Search Warrant Ruling Is Indorsed by Attorney for State Group. Hearty Indorsement, of the stand taken by Municipal Judge Thomas E. Garvin in ruling that it is not necessary to have made a purchase of liquor in order to obtain a search for a raid, has been voiced by the Indiana Anti-Saloon League. Judge Garvin declared Thursday that he would issue search warrants when policemen convince' him that violations of the dry law are occurring, even if they themselves have not made purchases. In the famous Wallace case the supreme court rules that belief of violation was not sufficient to obtain a search warrant, but that officers actually must know' of liquor selling before a raid may be made. This decision tied the hands of many courts which would have lssued warrants on belief, it was said. League approval of Garvin’s stand Is contained in a statement issued b’- Ethan A. Miles, league attorney, who defended the late Dr. £. S. Shumaker in his contempt case. Praising the judge for his stand, Miles said: “Judge Garvin simply has gone back to the Constitution a: it has been interpreted all along for more than 100 years.” GROUP TO BE NAMED Board Considers Appraisers for Two Churches. County commissioners today were considering names of six prominent Indianapolis business men to act as appraisers in the purchase by the county of two churches on the site of the Indiana War memorial. Appointments probably will be made this week as first definite steps get under way by the county toward purchasing the First Baptist and Second Presbyterian churches for completion of the memorial plaza by 1933. Names under consideration are Fred Hoke, vice-president of Holcomb & Hoke Manufacturing Company; J. K. Lilly, president of Eli Lilly Company; Frank D. Stalnaker. president of the Indiana National bank; Arthur V. Brown, president of the Union Trust Company; Fmleric M. Ayres, president of L. S Ayres Cos., and Elmer W. Stout, pi csident of the Fletcher American National bank. City I.oser in Tax Fight WASHINGTON, Feb. 24 —A city can not sue for unpaid back property taxes in a federal court outside ol the district in which the city is j located, the United States supreme court ruled today in a million dollar case brought by the treasurer of Grant county, Indiana, against the estate of Richard Edwards Breed in New York.
