THAW ENJOYS SPANKING SUIT CASE EVIDENCE Glares at Plaintiff and Waves to Reporters in Courtroom. flu r fiitftl Prm NEW YORK, Oct. 18.—Harry K. Thaw has returned to Broadway, but as a defendant in a SIOO,OOO damage suit instead of for his more usual fling with the night clubs. Thaw appeared unexpectedly late Thursday in the courtroom where the suit of Marcia Estardus, former night club hostess, who accuses Thaw of biting and spanking her during a New Year’s eve party in 1927 was in progress. He was there only for the closing minutes of the day's proceedings, but seemed to enjoy it. He consulted with his attorney, glared at Miss Estardus, waved cheerily at reporters, and was prevailed upon to pose for photographs. Miss Estardus had concluded her testimony before the defendant’s arrival. Morgan Pendleton, Thaw’s secretary, was on the witness stand

NO CHANCE OF WEDDING i Constance Bennett Does Not Intend to Remarry. By I'nitetl Prut CHICAGO, Oct. 17.—Constance Bennett, “takies” star, was in such haste to board a train that would take her on her way to Paris and the man who gave her $1,000,000 alimony'last spring that Chicago got only a brief glimpse of her today. She said there is no chance of a remarriage to Phillip Plant, the multi-millionaire she divorced in Paris early this year. ’’Just a trip to see Phil,” she explained.

and related his version of the incidents which led to Miss Estardus’ suit. Pendleton flatly contradicted Miss Estardus’ account of a hairbrush beating at the Thaw apartment. He said the woman had suggested they go to Thaw’s apartment and that Thaw did not put in an appearance until six hours after he and Miss Estardus had been there alone together. “During the time Miss Estardus was in the apartment, did you see anyone strike or bite her,” the witness was asked. “No, sir,” he replied. Miss Estardus wept during Pendleton’s testimony, as she had done earlier in the day when giving her own version of the Thaw party.
