(Colo.) banker, won a temporary delay in hi* case in federal court here today. When the case, charging use of the United States mails to defraud, came up before Judge Alfred Coxe. the delay was granted after a spirited argument between United States Attorney Charles Tuttle and Waggoner’s attorney, Allan R. Camp- i bell. Campbell had asked for two weeks adjournment, saying he would not have time to interrogate the scores of witnesses the government expects to have present early next week in prosecuting the banker, who "took” New York banks for $500,000 ride. He won the concession, however, I
of being allowed to look ifi all books and records which the government has in its possession. He also received permission to interrogate the government’s witnesses. Attorney Tuttle, in addressing the court, said the case was a very simple one, but tnat he understands a plea of some kind of kleptomania is to be made. Tuttle said he also understood a defense will be set up that Waggoner suffered from a form of “impulsive insanity.” Waggoner was brought into court by two deputy United States marshals. He appeared in better health than when he was first captured His wife, two nieces and other witnesses from the west were also present.
