SLAIN CHIEF'S EFFIGY OFFERED AS EVIDENCE Finally Ruled Out by Judge at 16 Textile Strikers’ Murder Trial. Bv nited Pres* CHARLOTTE, N. C., Sept. 5.—A black-draped, life-size effigy of the lata Police Chief O. F. Aderholt of Gastonia was brought into the court room where sixteen textile strikers are being tried for his murder today. Defense attorneys jumped to their feet shouting objections. State attorneys ordered the monel to enable Dr. H. R. MacConnell, Gastonia, the first state witness to point out where the peace officer had been shot. .. .. Aderholt in a sanatorium after the gun battle June 7, testified the wounded officer said: "I don’t know why they shot me because I’ve always tried to keep Garfield Hays, defense attorney, objected to this evidence, and Judge M. V. Barnhill sustained MacConnell pointed to various places of his body in explaining where Aderholt was wounded. Startles Courtroom Then the effigy was brought in. Judge Barnhill ordered the black cloth removed and the crowd in the courtroom gasped. Before them stood a likeness of the slain Gastonia officer, in a peace officers’ uniform. .. Mrs. Aderholt, widow of the officer, and her beautiful 21-year-old daughter, burst into tears and turned their eyes away. Meantime, defense counsel continued their battle to force removal of the model. The court ruled in their favor and when attendants were slow in removing it, he said: "Didn’t you men hear me ask you to take it out? Take it out now.” Dr. MacConnell then was called upon to identify the bloody clothing of the chief. The officer’s coat and bulletpunctured underwear were placed on the shoulders of State Attorney George Mason and MacConnell began a rapid description of the twelve wounds that killed Aderholt. The widow and daughter wept quietly. Attorneys Reproved Lawyers had grouped around the chair while the witness stood nearby describing Aderholt’s wounds. Judge Barnhill remarked "Gentlemen, we are observing most unusual court procedure,” and the attorneys moved back to their tables. MacConnell held Aderholt’s police coat before the jury and pointed out the numerous bullet holes in it. The coat was handed to jurors, each inspecting it carefully. The jurors, three of them coatless, filed in at 9:25 o’clock and Judge Barnhill opened court. Nell Battle Lewis of Raleigh, N.C., famous state liberal, was admitted to the bar, in an impressive ceremony, before testimony was started. "You come from ancestors who helped make history in North Carolina and have made a reputation yourself," Judge Barnhill said in greeting the new lawyer. Sprinkling of Women There was a sprinkling of women in the audience as testimony started but for the most part the spectators were men. Nineteen witnesses were called by the prosecution. Dr, MacConnell was cross-exam-ined briefly and then released. W. E. Leeper. civil engineer of Gastonia, who drafted a blue print map of the locality in which Aderholt was killed, was the next witness. On the map. he pointed out various houses and buildings near the strikers headquarters. Copies of the map were handed the jurors.

ADOPT ROOT PLAN Formula for World Court Adherence Accepted. Bit United. Press WASHINGTON, Sept. s.—Elihu Root’s formula for American adherence to the world court formally was adopted as an administration project today. Secretary of State Stimson announced the Root formula met the objections of the senate and fully protected the United States against dangers anticipated by the senate in adopting five reservations to American adherence. American acceptance of the formula is conditional upon ratification by other court members and about a year is expected to* elapse before ratifications are complete and the formula can be submitted to the senate, it was said.
