FACTORIES LOSE POWER DECISION Refused Plan for Monthly Charges, May Appeal. Large power users here today are eonsidering the possibility of an appeal from the public service commission order handed down late Thursday denying their petition for putting electric rate charges of the Indianapolis Power and Light Company on a monthly instead of the present yearly demand basis. The order, written by Commissioner Howell Ellis and of which no copies were available for the pjf x based denial on the grounds of negligible benefits to the majority of power users in class “D” riid increased expenditures and loss in revenues to the company. Commissioner Prank Singleton refused to join in the decision, but tl.e other three members did. The order pointed out that the switch of a monthly demand basis would mean a revenue loss of $40,758 according to company and commission figures and the gain to t<-n of the petitioners would be but $1,700. Albert E. Smollenger, attorney for the power users, stated that the matter of appeal will be discussed, but he considered it unlikely that the case will be taken into court. Ellis left today for a hearing at Vincennes and could not be reached *o elaborate on his conclusions. The petitioners included many of the leading manufacturers of the city. It was filed in the name of the Lcodv Manufacturing Company and others. BEAT PAVING BILL State Wins Court Fight on Highway C'la ui. Indianas highway commission won a victory today when the appellate court reversed the decision of the Marion county superior court giving the Scott Construction Company $67,842.76 as balance due on a contract with the state for paving between Shoals and West Baden. In reversing the case, which was appealed by the state through the attorney general’s office, the high court set out that the lower court erred in refusing the motion of the state to submit the facts and law upon which the decision was based. A new’ trial was ordered in the lower court. BILL 15 ON CRIMES Seven Persons Charged With Vehicle Taking. Fourteen affidavits, charging fifteen persons with violation of criminal laws, were on file in criminal court today. Seven persons were charged with vehicle taking while others were named on liquor law, crand larceny and embezzlement allegations.
