‘AUTO PICKUP’ LOVE TALE TOLD IN DEATH TRIAL Wife Who Accepted Ride in Clubman’s Car Testifies on Rich Mate’s Killing. By United Press NASHVILLE. Tenn., Jan. 24. Mrs. Era Helen Cunningham's admissions of an illicit love affair which culminated in the murder of her husband, Turner M. Cunningham, prominent Nashville clubman, drew throngs of curious thrill-seek-ers today to the murder trial of Walter L. Liggett, wealthy grain dealer. Mrs. Cunningham, 35, related without hesitation the complete story of her love for Liggett, whom she confessed she met when he picked her up in his automobile six years ago Her story continued through every step of their friendship to the night when her husband was murdered at their home a few minutes after Liggett had kissed her good-bye saying he “wasn’t afraid of anyone in the world.” Tells of Secret Love Mrs. Cunningham, testifying in the presence of her former lover, told of secret meetings and a weekend trip out of town while husband was absent on business. She admitted having spent a week-end with Liggett in a hotel at Columbia, Tenn., and said he had asked her to divorce her husband. “I told him I had no grounds for divorce.” Mrs. Cuningham said. Her first meeting with Liggett occurred on a street corner where she was waiting for a street car, Mrs. Cunningham said. She said Liggett, a stranger to her then, drove up beside the curb and asked her to take a ride. She accepted the invitation, she said, and kept an engagement with him the following day. Husband Fatally Wounded “One day. he took me riding through a pretty driveway. He showed me a house along a treelined boulevard and asked me if I wanted him to buy it for me. “He wanted me to get a divorce, then,” the widow related. On the night of Cunningham’s murder, the widow testified Liggett saw her at her home. “He kissed me good-by and declared he wasn't afraid of anyone in the world. Then he left by the rear door. As he left he put his bands in his hip pocket.” A moment later, Mrs. Cunningham said, she heard several shots and ran outside and found her husband fatally wounded.

ASSEMBLIES OF 2 STATES FIGHT ON EVOLUTION Texas and Arkansas Revive Arguments on Theory in Proposed Laws. By United Press DALLAS, Tex., Jan. 24.—Legislatures of two southwestern states were involved in heated debate today over the theory of evolution. At Austin, Tex., evolutionists succeeded in winning a victory over their opponents by defeating a measure proposing to prohibit the teaching of the theory of evolution. The anti-evolution bill was killed in committee but there was every indication, judging from debate, that the controversy is not ended The lower assembly branch of the Arkansas legislature, in session at Little Rock, was thrown into an uproar by introduction of a bill to repeal the existing anti-evolution law, passed by an initiative vote at the November general election. The bill now is in committee. The Texas anti-evolution bill was killed by a vote of 8 to 3 in the committee on criminal jurisprudence in secret session. The measure sought to. make it unlawful for 'any teacher or instructor in any, state supported educational institution, to

The introduction of the repeal measure in the Arkansas assembly was seen as the beginning of a bitter controversy between fundamentalists and evolutionists, who long have carried on their controversy outside the legislative chambers, Arkansas’, anti-evolution law, brought into national prominence by the hunger strike of Charles Smith, atheist leader. Fundamentalists countered the repeal measure by introducing a resolution in the house which would provide a commission to design methods of more strict enforcement of the present anti-evolution law. The measure, which would repeal the present law, must obtain a twothirds vote in both houses of the assembly for passage. Opponents of the bill predicted it would be defeated in committee.
