U. S. TO RETURN HOME SEIZED 65 YEARS AGO Fremont Property in Heart of San Francisco Now Worth Millions. BY MAX STERN Times Staff Correspondent SAN FRANCISCO, Dec. 14. Across a span of sixty-five years the long arm of justice is reaching out “to right an ancient wrong.” This is to restore to its original owners and their heirs the home of General John C. Fremqnt, “America’s Pathfinder,” first Republican presidential candidate and one of the early makers of the west. In 1860 Fremont was a rich man who owned the great Mariposa mine, worth $10,006,000. He moved to San Francisco with his family and bought fifteen acres on Black Point, an arm of land overlooking Golden Gate, jutting from the San Francisco peninsula. He paid $42,000, and built a $40,000 house. There he lived until 1863, when he wac called back to Washington to take command of the department of the west. Seized Site for Fort That same year the United States government fearing a raid upon California from England and France, rumored to be planning to take advantage of the Civil war and America’s defenseless seas, ordered the Black Point property seized for a fort. The question of “ownership” was “to be determined later.” Ft. Mason was created. Fremont sought to secure from the government remuneration for

His widow fought on to persuade congress to pay for the land., She also died poor in 1901. Comes now Benton C. Fremont, grandson of the “Pathfinder,” to carry on the fight. The property, now in the heart of San Francisco, is worth millions. Promises City Park In 1870 congress voted to relinquish to certain owners just inside the tract some fifty acres. Os the remaining fifty-five and one-half acres of the fort grounds, fifteen

acres are claimed by young Fremont for himself and fellow heirs; a portion by Colonel Leonidas Haskill, the former Haskill home; a park site of two city blocks, formerly Alcatraz park, claimed by the city of San Francisco. J. J. O’Toole, city attorney, has written an opinion urging San Francisco to join with young Fremon’t request before congress that the Ft. Mason property be returned to its original owners. By this the city would regain Alcatraz Park. Young Fremont has promised to sell the Fremont home site to the city for park purposes at 5 per cent less than its own appraisal thereof. Fremont says the request has been before twelve congressional committees and never has been turned down.

UNCOVER ANCIENT ROAD OF ROMAN EMPEROR Land Reclaiming Operators Lay Bare First Century Highway. By United Press NAPLES, Dec. 14.—The ancient Roman road, built by the Emperor Domitian, and known as the “Via Domitiana,” traces of which were found during recent land reclaiming operations near Litemo, anciently known as Liternum, has been laid bare for a distance of 400 yards near the village of Varcaturo. The ancient road, built in the first century of our era, is in excellent state of preservation, and follows the usual system of large

stones of circular and oblong shapes pressed into the ground. The road in the section excavated measures between four and a half and five yards wide, and was constructed to allow the passage of two lines of traffic in opposite directions. CLANG! CHIEF’S AFIRE URBANA, 0., Dec. 14.—D. M. Driver, Hicksvilles fire chief, put out one fire without moving out of his tracks. He was talking with friends when they noticed smoke and gave the alarm. The smoke was coming out of the chief’s pocket, which had been set on fire by a lighted pipe.

CONTROL AUTO TRAFFIC Philippine Council Copes With It by Prohibiting It. By United Press MANILA, Dec. 14.—Motor traffic is well under control in the town of Maragandon, Cavite province. By fiat of the local lawmakers, there just isn’t any motor traffic. The town council passed an ordinance prohibiting the operation of all motor vehicles upon any street of the town. The idea seeiris to have been to give bull-carts and horse-drawn carriages plenty of elbow room. Outraged operators of bus lines finally obtained publicity on the council’s act and enlisted support
