BARRISTERS TO CONSIDER NEW GOURTSYSTEM Important Changes in Rules to Be Proposed at Meeting Tonight. Minor changes in county court rules and strengthening of others are embodied in the proposed new uniform court laws that will be presented to the Indianapolis Bar Association tonight at the monthly meeting at the Columbia Club. Tonight’s meeting will be one of the most important of the year, association officials said. The new court rules, election of officers and reading of the report on the investigation into activities of the criminal municipal courts by a special bar association committee are slated to come before the members. • Michael E. Folej', local attorney, has been nominated for the presidency without opposition and will be elected this evening. Special attention has been called by the rules committee to several rules that are contained in the pro • posed changes. Included in these is one stating that in order to become a party to a pending suit, the intervenor must file a petition, under oath, showing cause and give notice to attorneys of the opposition, either in writing or in open court, before the privilege will be granted. That removal of papers filed in cases at issue before the court, without permission of the court, is punishable by contempt citation, also is set out in the proposed draft. Changes of venue can be obtained only if the motion for the change is filed at least five days before the case is to be tried. If attorneys representing each party can agree on llic county where the case is to go, the court will approve it, otherwise the court shall name the county, it is stated.. Rules to answer or reply in any case will be discharged within one week after the rule is entered, unless another day is specified, under the proposed regulations. Failure of attorneys to discharge a rule will be followed by default and notice of this will be given two days before default is taken. A receiver, under the new rules, will be required to report at the first of each alternate month, after his qualification, a summary of activities and a statement of the assets and liabilities of the trust. Failure to do this, will result in a hearing to determine whether the receiver should be discharged.

WFBM TO OPEN BASKETSEASON Indiana-Pennsy Game to Go on Air Thursday. Once more the season when the toot of the basketball official’s whistle and the raucous razz of the fanatical fan thrills the heart of the radio sport fan has arrived. With broadcast of the dedication of the new field house at Indiana university, Thursday night, and the game between Pennsylvania and Indiana, WFBM will inaugurate its basketball season. The broadcast, sponsored by the Washington Bank and Trust Company, will be the first of eight Indiana games put on the air by this institution, which will include all the Crimson’s home Big Ten games and the Purdue-Indiana game at Lafayette. The game Thursday will begin at 8:15 o’clock and WFBM, with the Hendricks brothers, Blythe and Tom, at the microphone, will open the festivities fifteen minutes in advance of the tip-off.

Counsel for Dreyfus Rhoades, under sentence to die March 6 in the electric chair for the murder of Simon Craie, Vincennes policeman, today were considering an appeal to the Indiana supreme court. A motion for anew trial was overruled in Gibson circuit court here Tuesday. Among grounds advanced for a rew trial was failure of the state to produce the bullet which caused the officer’s death. The defense asserts the bullet is in custody of the Vincennes police department and that it is not similar to those on cartridges with which a revolver belonging to Rhoades was loaded. DEATH JURY DISAGREES Fails at Verdict in Slaying Charged to Uhle Ferguson at Marion. By United Press MARION, Ind., Dec. 12.—After deliberating more than eight hours a Grant circuit court jury trying Uhle Ferguson, 23, accused of slaying Orville Goodpasture, 22, reported that it could not agree. Ferguson and 1 Charles Mauller were indicted for second degree murder following the finding of Goodpasture’s body along a lonely highway Sept. 1. The state charged that one of the mem struck Goodpasture and that in falling his neck was broken. Ferguson testified that Goodpasture was intoxicated and fell. Mauller obtained a separate trial, which is to open Monday.

GILUOM FILES FINAL BRIEF IN SHUMAKER SUIT Dry League Chief's Case Is Now Up for Decision by High Court. With filing of a final brief late Tuesday by Attorney General Arthur L. Gilliom, the last round of the Shumaker contempt case awaits final decision today. The court, which fined the Rev. E. S. Shumaker, secretary of the Indiana Anti-Saloon League, $250 and sentenced him to serve sixty days at the Indiana State Farm for contempt, now must decide whether the imprisonment still holds. Shumaker went to the Farm, paid his fine, and was pardoned from serving the imprisonment sentence by Governor Ed Jackson. Gilliom, who had instituted the contempt proceedings, then moved that the court impose sentence, on the ground that the Governor had no power to pardon in a contempt case. Attorneys for Shumaker moved dismissal of the Gilliom motion, which was denied. They then filed demurrer to motion in execution of judgment and briefs in support of their contention that the Governor was within his province ih issuing the pardon. That is the questior now awaiting court decision. Should the justices rule favorably upon Gilliom’s motion in execution of judgment, the dry chief will have
