JUDGE CHOICE BY GOVERNOR, 1 BARISURGED System to Secure Ablest Advocated by Lawyer, S Senate Candidate. 1 Suggestion that Indiana judges be appointed by the Governor, frorr lists nominated by bar associations as a means of insuring that the ablest lawyers be placed upon the bench was made today by Joe Rand Beckett, Indianapolis attorney. Beckett is a Republican candidate lor state senator. He said he was not advocating the judiciary reform as a campaign stunt, but made public his suggestion at this time with the idea that there be time for wide discussion of it before the 1929 state legislature meets. ' Pointing out that the public gen erally is dissatisfied with the courts. Beckett declares the chief fault lies In the method of selection of judges. Politics Drawback “It is unfortunate that courts of this state now are selected for their party affiliation,” he said. Even though a man is capable and able, he must resort to his vote-getting ability to be elected to office. This one feature is a condition that keeps many capable lawyers from being willing to run for a position on the bench. An able man often does not desire to submit his chances of success to his ability to line up a backing for himself on a political basis. ' “Again, a judge who wishes to be returned to the bench by re-election must think of re-election during his term of office. Human nature is not strong enough to make a man independent of the feature of personal success constantly before him, even though his desire is to be uninfluenced by all facts outside of the decision he is about to render. Bar Would Select Three “Nearly all agree, after some thought and looking to courts outside the state, that the appointive power with a longer period of service is the best way to secure judges of outstanding ability, integrity and independence. “The bar associations of the state and counties, if recognized as an instrument of government, and certain rules laid down governing their selection, could be relied upon to select such men. Such associations should include all lawyers practicing at the bar. Nominations should be accepted from membership at large (not by nominating committees), and the same voted on until, say, three attorneys of good standing were selected for the position to be filled.” Longer Term Urged The three nominations should be designated as first, second and third choice. The final appointive power could rest with the Governor. At present the period of service of from four to six years is too short. It is recognized that a judge must relinquish his private practice. If the period is short, capable men will hesitate to give up a lucrative practice for with the fact before them of losing their their practice, and being required to build it up again after a short period of service, if they are not reappointed. Ten years should be the shortest period for such service of any able man, and life appointment is favored in many localities.
