CHEATS CHAIR i AT DEATH HOUR Last - Minute Clemency Saves Bandit. By United Press AUSTIN, Tex., Oct. 26.—Saved from the electric chair by a last minute commutation of sentence, J. R. (Bob) Silver today faced life imprisonment for the murder of a Ft. Worth theater treasurer. Silver had been scheduled to pay the extreme penalty shortly before midnight, but Governor Don Moody extended clemency. W. A. Stone, with Silver in |he theater holdup Jan. 31, 1927, is serving a life sentence for his part in the robbery and it was on that basis that Moody saved Silver from the chair. “This is an instance where both parties in a crime have been apprehended, tried for the same offense, upon the same facts, and one received the death penalty and the other life imprisonment. In this instance the two men did not receive equal punishment,” Moody said in explaining his commutation.
