when the grand jury opens its fall term here Monday. The much discussed Hanson case to be brought before the grand jury, promises a bitter fight over the question of state rights. The case had its incepttion when Jacob D. Hanson, secretary of the Niagara Falls Elks, was shot in the head by cooast guardsmen last May 6. Hanson was driving his car on Lewiston Hill, near Niagara Falls, and when he failed to halt his car "after being commanded to do so, was shot in the head. Glenn Jennings, a coast guardsman, alleged to have fired the fatal bullet, and Frank Beck, in charge of Fort Niagara, subsequently were indicted on charges of second degree assault. The men technically are under arrest in coast guard service, al-

though released on bail by state authorities. The recent death of Hanson, who spent three months in a Niagara Falls hospital after going blind and becoming a mental defective, has changed the aspect of the case. District Attorney Knowles of Niagara County said he will go before the grand jury with the new facts and ask that anew indictment of either murder or manslaughter be preferred against the men. The Federal government, through United States Attorney Templeton at Buffalo, has announced that it will bend every effort to try the case in Federal Court, inasmuch as the men are Federal officers. The trial is expected to decide two great questions of major importance, the question of State rights, and the second, whether Federal law enforcement officers have a right to open fire without fully in-

vestigating on persons traveling upon a public highway. Federal authorities claim the men were fully within their rights in opening fire, whereas State officials contend the shooting was committed without proper authority. The wife, according to the plea to the high court, was prepared to present an alibi for her husband, but was denied the right to take the stand, and he was sentenced to three years in Federal prison at Atlanta, and pay SI,OOO fine. The contention is made that under modern conditions the time honored rule that a wife can not testify in defense of her husband in a criminal case should be changed. Congress by statute has removed the ban on a wife's testimony for the defense in criminal cases in the District of Columbia, but in other Federal courts throughout the country, according to the Department of Justice, the procedure to bar the wife's testimony.
