DUNCAN WILL APPEAL FROM JURY VERDICT

Sentenced to Two Years in Prison, Fined $2,000 for Forgery. State Representative Russell V. Duncan today was preparing appeal of his conviction on charges of forging a Government check in Federal Court late Thursday afternoon. A jury convicted Duncan and acquitted Charles W. Tilton, former internal revenue employe, jointly indicted. Duncan was sentenced to two years in Leavenworth prison and was fined $2,000 by Special Judge Walter C. Lindley, Danville, 111. He was released Thursday evening under SIO,OOO appeal bond. His attorney, Milton Clawson, was given thirty days to prepare a bill of exceptions.

Forged Indorsement Duncan and Tilton were charged with forging indorsement and. cashing a $3,094.91 Government check, payable to John W. Smith, deceased Muncie manufacturer, representing excess income tax refund. Tilton denied any knowledge of the missing check. Duncan testified the check was given to him in a real estate deal by a Chicago broker 1 , claiming to be “John W. Smith.” The Government attempted to prove Tilton took the check from the internal revenue office shortly before he became an employe and forged Smith’s indorsement. Both Government and defense attorneys called handwriting experts to compare Tilton’s admitted signature with the check indorsement. The Government's experts testified Tilton’s signature resembled the check, indorsement. Defense attorneys could find little similarity. The jury returned the verdict after deliberating an hour and forty minutes. “I'm Not Guilty” “I am not guilty but I feel that the Court gave an impartial trial,” Duncan told Lindley after hearing the verdict. Neither Duncan nor Tilton rhowed emotion over the verdict. Tilton left the Federal Bldg, with his wife and ten-months-old daughter, while Duncan busied himself with arranging bond. Both Duncan and Tilton were convicted a year ago, but won retrial from Circuit Court of Appeals on a technicality. The nest, with three eggs in it, was found by Walter on the truck frame. The machine is being used daily but this does not disturb the bird.

Samuel E. Boney, director of the Utilities Information Bureau placed in evidence merits of the books from a uulities standpoint. “We are scanning the textbooks on civics and economics used in the North and South Carolina schools, and find that many are antiquated and highly prejudicial.” Boney said in a letter introduced. “We are hoping through quiet and diplomatic efforts to have some of these inimical textbooks discarded.” Cross-examined on the survey, Boney said his bureau had never taken any direct action to have removed the books they diliked. A letter written by Prof. H. C. Brearlev of Clemson College, South Carolina, in which Boney was rebuked for suggesting a survey of textbooks used in the Carolina schools, was placed in evidence. “I am interested to hear more of your proposed survey of tjje textbooks in economics and civics.”
