JURORS UNABLE TO DECIDE FATE OF MRS. KNAPP Hopeless Deadlock Ends in Discharge; Retrial Set for May 21. BY PERCY B. SCOTT United Press Staff Correspondent ALBANY, N. Y., May 9.—The second trial of Mrs. Florence E. S. Knapp, former Secretary of State, on a charge of larceny, which grew out of her administration of the $1,200,000 census fund, will begin May 21. The rst trial ended at midnight last night, with the jury reporting itself hopelessly deadlocked. The twelve men had the case under advisement approximately seven and a half hours and Justice Stephen H. Callaghan, after questioning each man individually, ordered them discharged and set the date for the retrial. Reports indicated the jury was about evenly divided between the innocence and guilt of the middle aged woman, first of her sex to reach a high elective office in the State Government. Affected by Outcome Mrs. Knapp was in the courtroom when the jury reported. She had been extremely optimistic while the jury remained out, but was visibly effected when the foreman reported *by could not decide on her guilt or inpocence. Before the opening of the trial Mrs. Knapp said she was certain of acquittal and wanted to use this method of vindicating herself and also vindicating women in politics. It had been a trying day for the former secretary. She had heard the opposing argument, heard her defense called brazen, and then had listened to Justice Callaghan’s (forty-three-minute charge. Urged Honest Verdict In this charge the justice had stressed the fact that the jury should not sidestep “a disagreeable duty,” if that became necessary, and urged an honest verdict. The charge Mrs. Knapp was tried on was for diverting a check for more than $2,500, drawn to the account of her step-daughter, Miss Clara Knapp. This charge was one of the twelve indictments voted by a special grand jury. Miss Knapp was the principal State witness against her stepmother, and in the course of the trial Mrs. Knapp testified that her stepdaughter had spoken untruthfully about the Census Bureau administration. URGES U. S. FARM POLIC Dakotan Pleads for Agriculture and Industry to Join. Pm United Press WASHINGTON. May 9.—A plea for cooperation between industry and agriculture in the formation of a national farm policy was made today by Roy Johnson. North Dakota farmer, to the sixteenth annual meeting of the United States Chamber of Commerce. “We have developed in this country a national banking policy, a national labor policy, a tariff policy in the interest cf manufacturing, a military policy, and just recently a radio policy, but in the case of agriculture, where a national policy has been needed for years, we are still at sea,” Johnson said.

This*last word in American passenger planes, with two others just like it, goes into service on the Los Angeles-San Francisco air mail line soon. The three planes were built at New York by Anthony Fokker. Each will carry twelve persons. They cost about SBO,OOO each. Part of the purchase money was supplied by the Guggenheim Foundation, as a loan to the Western Air Express.
BARE DESPOTIC RULE IN MIAMI Torture System Revealed in Police Department. Bn United Press MIAMI, Fla., May 9.—A report of the Dade County grand jury published today declared the Bastinado and various other tortures of the middle ages have been revived in present day Miami. After a three months’ investigation into police department affairs the jury reported despotism “of a nature to destroy the freedom of our citizens” existed , that the department was in alliance with “gamblers, bootleggers and the underworld in general.” Police Chief H. Leslie Quigg, suspended, was named “as wholly unfit for office.” The report said that from testimony of witnesses, it was found prisoners failed to “talk” were placed in an electricity-charged chair with a policeman standing over them ready to knock them down if they tried to get up." One witness testified' a prisoner was beaten for an hour and a half on the bare soles of his feet with a copper ruler. W. D. Robson will talk on “Oil Burners’ at an Indianapolis Home Builders’ Association dinner at the Marott Hotel tonight.

TEN KILLED AND MANY BURIED BY LANDSLIDE Mine Destroyed: Rescue Workers Hack Through Debris. Pi/ United Press BOGOTA, Colombia, May 9.Ten persons were known to have been killed and many more were believed buried today, as a result of landslides which destroyed the “Vende Cabezas” mine near Rio Sucio in the department of Caldas. . It was unknown just how many persons were at work in the mine at the time of the landslide. Rescue workers were busy throughout the night attempting to clear a path into the mine. It was believed many miners still were entombed and might be saved if a pathway could be made through the debris within a few hours.

STRONG LOBBY FIGHTS SHOALS BILL, UP TODAY Defeat Feared for Norris Measure, as Result of Intensive Drive. By C. J. LILLEY WASHINGTON,' May 9. Attempts to canvass each member of the House and persuade him to vote against the Norris bill for government operation of Muscle Shoals have been made by the fertilizer lobbyists, Congressmen said today. The Norris bill conies up for consideration with more lobbyists In Washington than ever have been here before, according to Representative Gamor, Texas. Traveling around the House office building in Paris, these representatives of the fertilizer interests urged rejection of the bill, on the ground that it would not benefit the farmers. Power lobbyists are exerting all pressure at their command against the measure as well, Garner and others said. The bill comes up for consideration when the House opens today with its strongest advocates fearful of the outcome. Predictions of its defeat were being made, because it is coming up on a calendar day. which gives opportunity for a filibuster to prevent final vote. If no vote is had today, the bill will be taken up on another calendar day next Wednesday. Representative Garrett of Tennessee is fighting the Cove Creek clause in the bill and is believed to have lined up considerable opposition through his position as minority floor leader. Garrett wants the Cove Creek clause amended or stricken out entirely.

HICKMAN GETS NEW LEASE ON LIFE BY APPEAL Challenge to Legality of Conviction Delays Execution. By United Press • SACRAMENTO, Cal.. May 9. William Edward Hickman, confessed murderer of 12-year-old Marion Parker, will have at least twenty more days to live. The State Supreme Court, to which the youthful slayer’s attorneys carried a fight for his life Tuesday, granted the delay after hearing arguments involving the constitutionality of the law under which Hickman was sentenced to hang. The court gave Maj. Walter K. Tuller, Los Angeles attorney and chairman of the California crime commission,which drafted the law, ten days in which to file a brief supporting its constitutionality. It then granted Hickman's attorney ten days more in which to file an answer to Tulier's opinions. Hickman's span of life eventually may amount to a month, it was believed, since the court’s final decision probably will not be made

until ten or more days after both briefs are filed. The law involved in the contitutionality dispute is that which permitted Hickman to plead ’“not guilty by reason of insanity.” Mr. and Mrs. Robert Lyall of Melbourne, Australia, delegates to the recent Disciples of Christ convention at Columbus, Ohio, will be guests of honor tonight at a dinner at the Central Christian Church.
