PRIMARY LAW MADE CLEAR FORJOTERS Candidates for Congress, County Offices, Judges to Be Named, BY ROBERT L. BEARI) With the primary election less than two weeks distant—Tuesday, Maty B—and Republican and Democrats alike pledged to “getting out the vote,” Mr. and Mrs. lioosier Voter will do well to acquire a “speaking acquaintance” with proof the State primary law. Without some such understanding, thousands of voters admittedly become so confused by the vast number of candidates, campaign hubbub and election jargon that they throw up their hands in bewilderment and “let the other fellow do the voting.” Salient features of the Indiana primary law are these: Nominated in Primary Candidates for the following offices in each political party must be nominated under the primary law, and nominations for these offices require only a plurality (more than any other one candidate) of the votes: Representative in Congress, State Senators and Representatives, judges of Circuit, Superior, criminal, probate and juvenile courts, prosecuting attorneys. All county officers, including treasurer, auditor, sheriff, recorder, circuit court clerk, surveyor, coroner, assessor, commissioners and county council members. Township trustees, assessors, justices of peace, constables and township advisory board members; All elective city officials (at a separate city primary). Preference Primary The primary law provides further that members of each party may express preference for the candidates of their party for President, ice President, United States Senator and Governor. If any candidate for United States Senator or Governor receives a majority of all votes cast in his party, such candidate shall be declared the nominee. If no candidate receives a majority the convention shall proceed to make the nomination. If, in the presidential preference feature of the primary, a majority is accorded a candidate for President or Vice President, such candidate shall receive the support of all of Indiana’s thirty-three National convention delegates so long as his name remains before the National convention. If his name is withdrawn, they are free to vote the sentiment of their respective districts. The seven delegats at large may vote the sentiment of the groups which effected their election. While the primary election generally is regarded as a nominative function, it has in addition two purely elective duties: Precinct committemen and State convention delegates are elected.
Convention Nominations Nominations which fall solely upon the State convention (and do not enter in the primary at all) are for lieutenant-governor, secretary of State, auditor of State, treasurer of State, attorney-general, clerk of the Supreme and Appellate Courts, reporter of the Supreme and Appellate Courts, State superintendent of public instruction and judges of the Sdpipme and' Appellate Courts as their terms expire. Terms of one Supreme and two Appellate Court judges expire this year. Office of Supreme and Appellate Court clerk does not expire until 1931. Nomination of United States Senator and Governor devolves upon the State convention only in case no candidate for either of these offices polled a majority of the votes cast in his party for such office at the primary. The convention then is not restricted to consideration of candidates whose names were ip the primary, but may go outside that list, as If there had been no preference vote.
