DELAY SOUGHT BY DEFENSE IN HICKMAN CASE jtwould Postpone Sentence Until Next Week; Year of Litigation Seen, BY DAN CAMPBELL United Press Staff Correspondent LOS ANGELES, Feb. 11 torneys for William Edward Hickman planned a move today, which, if successful would delay until Tuesday at least, a sentence of death expected to be given the conviced slayer of 12-year-old Marion Parker. When court convened today Jerome Walsh and Richard Cantillon, youthful defense counsel, were prepared to present a motion for anew trial, based on a contention that Judge Trabucco erred in his Instructions to the jury and also on a ruling during Hickman’s tanity trial. If the defense motion is denied, Judge Trabucco may impose upon Hickjnan, declared sane and guilty of kidnapping and murder, either death by hanging or life imprisonment at hard labor. Under the statutes of California, Hickman, if sentenced to die and all appeals are denied, cannot be hanged for at least sixty days. Little Worry About Penalty There seemed little doubt, even in the minds of Hickman's attorneys, but that Judge Trabucco would demand, the death penalty. The prospect of a long legal struggle was strengthened by announcement of Walsh and Cantillon that if their motion for anew trial is denied they will appeal the case, if necessary, to the United States Supreme Court. Such an appeal would be based, they said, on the contention that Hickman had not been tried on his guilt or innocence and that consequently he is being deprived of his constitutional right. The move against the constitutionality of the California law had been predicted generally before the verdict was announced. Attack on Law Expected Legal experts had prophested that the law, which accepted Hickman’s plea of “not guilty by reason of insanity” as an admission of the crime, would be attacked. * Walsh declared: * “Under the constitution Hickman is guaranteed a trial on his guilt or innocence, if he pleaded not guilty. He did this but had only a sanity hearing.” Walsh said that in his opinion it would be a year before litigation in Hickmana’s case is settled. FIGHT CLOSE ON POWER LOBBY Senate Vote on Inquiry Is Regarded as Tossup. By Times Special WASHINGTON, Feb. 11.—The fight of a $17,000,000,000 power lobby to smother Senator Thomas J. Walsh's proposed senatorial investigation of the power industry by transferring the inquiry to the Federal Trade Commission is out in the open, with prospects of a close vote when the Senate decides next week. The lines are so evenly drawn that the outcome is a toss-up. Only one thing appears certain—that the debate beginning Monday will be one of the hottest battles of the session and conditions are such that one vote may decide. Party lines have been absorbed in a battle between liberals and conservatives, marked by such oddities as Senator Couzens, being a strong advocate of the Walsh plan and Senator Robinson, Democratic floor leader, being opposed to it. Defections among the Democrats have robbed Walsh of much support he had expected. Even the author of the amendment to transfer the inquiry from

Carl Robbins, Tulsa, Okla., senior in De Pauw University here, is suffering from two slight knife wounds in the side, inflicted about 10:30 Thursday night by two men. Feb. 10.—Because she shot and killed her partner in a bridge game when the latter played a wrong card twice in succession, Mrs. Mary Lee Bishop, Negro, was sentenced to life imprisonment here.
