COURT SITS IN FIGHT ON TAXES IN BEECH GROVE Injunction Sought Against Assessment Collection by Robinson. Special assessement taxes on every lot in Beech Grove are affected in a suit heard today by Judge Joseph M. Milner in Superior Court Five. The action is a suit for injunction against County Treasurer from collecting special assessment taxes on street improvements in Beech Grove, ' 'vied by the town council more than two years ago. About $2,000 in foxes is involved, threatened with iieup as result of the action. Point of contention rests in the authority of the town council to make the levy, according to the petition. Its authority is attacked, and the assessment books are branded as illegal and as not being certified correctly by the clerk to Tresasurer Robinson for collection. Abutting property was assessed i"ider the abutting property law for -\s pro rata share in the street improvement, but no provision made for street intersections. Due to this, the town council made a special levy, due in four semi-annual instalments. When these became delinquent, the town clerk sent the list to County Auditor Harry Dunn, who advertised the lots, every one in Beech Grove, for sale. At this point the suit for injunction was filed. Precluding possibility cf a tieup of collection of all delinquent taxes, Dunn advertised the Beech Grove group in a special advertisement, and only this is attacked. The suit is brought by the Securities Finance Company. The petition states this company also represents all other property owners.
