NICKEL FARE ON LAST LEG IN NEW YORK Lines to Take Fight for Increase to Federal High Court. By L tilled Press NEW YORK, Feb. 2.—The 5-cent lare, now only a memory in most American cities, has been called to a showdown in its last great stronghold—New York. The transit commission had before it today an application of the Interborough Rapid Transit Company for an increase to 7 cents on its subway and elevated lines. The Interborough gave every indication of intending to make this a real battle to determine whether the city can force it to operate at a 5cent fare. The commission will not grant the increase, and the company intends to carry it to the Supreme Court of the United States, if necessary, on the ground that the involuntary 5cent fare is a confiscation of its property rights. The impending battle will be watched with interest in cities everywhere, which have had their own transit battles in the last decade and have seen the fares rise from four and five cents to seven, eight, nine and even ten. Some transit experts claim that the decision may be the final test of alow fare under present living conditions, arguing that profitable operation at five cents, if it is feasible anywhere, is feasible in New York, with its enormous traffic volume and heavy twenty-four-hour-a-day revenue. The point at issue in the New York fare battle will be whether a contract between the Interborough and city, stipulating a 5-cent larc. can be declared invalid, on the ground that the company does not earn the 8-cent profit recognized as equitable for a transit company. The Interborough carries well over a third of the approximately 3,000,000,000 passengers carried in New York in a year. Petition asking authority of the public service commission to establish a truck route between Shelby - ville and Cincinnati has been filed by R. A. Pearson of Shelbyville.

‘EGGS’ HATCH INTOALCOHOL Three Sentenced Under Dry Law at Columbus. By Times Special COLUMBUS, Ind„ Feb. 2.—“ Eggs" which hatched out as two one-gal-lon jugs of alcohol between the farm of Ollen Chew, near Sulphur Springs, and and the home of Mrs. Ella Litt here, brought trouble to her, Charles Woolums and William Pennington. Mrs. Litt was fined SIOO and sentenced to six months in the Indiana Woman’s Prison; Woolums, SIOO and 90 days at the State Farm, and Pennington, SIOO and thirty days at the farm . Police were waiting at the Litt home when the three returned from the country in Pennington’s automobile, from which they removed a market basket such as used for carrying eggs, but which contained the alcohol jugs. Chew was arrested later and is awaiting trial. A business concern founded in 1108 still flourishes at North Walsham. England.
