‘STOOL PIGEONS’ IN RUM CASES UNDER ATTACK - Federal Use of Spies Draws Prosecutor’s Ire in City Court. Federal dry agents’ use of undercover men, “stool pigeons.” to get liquor case evidence was assailed before Municipal Judge Paul C. Wetter Wednesday. Deputy prosecutor John Royse declared he was “tired” of trying to prosecute cases In which Federal officers sat in autos several blocks away and watched “stool pigeons” buy liquor and in which the “stool pigeons” never appeared in court to testify. Work Oat New Plan He has lost nine liquor cases this week because the dry agents had not bought the liquor themselves and could not give first-hand testimony that the liquor was sold by the person under arrest. He sent word to Deputy Federal Prohibition Administrator George L. Winkler, through Dry Agent Otto Mays, to work out anew means of getting liquor law violation evidence in Indianapolis. Mays had testified that he sat in an auto two blocks away while Ed Steinberg, an under cover man, bought a pint of liquor from Thomas Porter, 50, Negro, of 543 W. TwentyFifth St. Dan Brown, Porter’s attorney, brought out that Mays couldn’t even
A Standard of Conduct The Supreme Court of the United States has defined a standard of conduct for motorists and others to follow for their own safety when crossing railway tracks. It is contained in the following extract from a recent decision of that court: “When a man goes upon a railroad track he kno\ys that he goes to a place where he will be killed if a train comes upon him before he is clear of the track. He knows that he must stop for the train, not the train stop for him. In such circumstances it seems to us that if a driver can not be sure'otherwise whether a train is dangerously near he must stop and get out of his vehicle, although obviously he will not often be required to do more than to stop and look. It seems to us that if he relies upon not hearing the train or any signal and takes no further precaution he does so at his own risk.” The decision in this case was that the railroad was not responsible for and should not have to pay damages for the death of a motorist that was caused by his failure to follow this standard of conduct. \ Such a conclusion is logical. Railway tracks are the Nation’s great highways of commerce and travel, and it is imperative that trains run on them at high speed and on schedule. Since these trains obviously can not be stopped at highway crossings\o let motorists and others get out of the way, it is therefore necessary for those who cross the tracks to be on the look-out for their own safety. The decision of the Supreme Court leaves no room for doubt on that point. This decision will in no way diminish the efforts of the Illinois Central System to prevent accidents at crossings. Our railroad will continue to do every thing it can do to avert such accidents. But this de“ cision makes it plain that, regardless of what railroad may do to guard against accident, those who croita the tracks are responsible for their own safety. This statement is published in the hope that a public understanding of the views held by the highest court in the land will be widely influential in safeguarding life and property at crossings. Claims Ruling Violated Brown contended that the search warrant and arrest warrant on which Sergeant Cox later searched the house and arrested Porter was illegal because it had been obtained on an affidavit by Mays, who had only the word of the “stool pigeon” that there was liquor there. This, he charged, was in violation of recent Supreme Court ruling that a search warrant can be obtained only on actual knowledge of the presence of liquor in the place to be searched.
