STEVE EVIDENCE IS DEFENDED IN STATE'S BRIEF No Reversible Error, Says Reply to Ex-Dragon’s Appeal Plea. Another step toward closing the D. C. Stephenson murder case appeal and getting it before the Supreme Court was taken Thursday with the filing of the State’s brief by Dale F. Stansbury, special deputy appointed by Attorney General Arthur L. Gilliom to prepare the manuscript. Defense attorneys have until Dec. 9 to file a reply brief, and then the case will be set for oral argument. Additional time may be requested. The State brief sets forth that failure of the Marion County Criminal Court clerk to sign the papers when change of venue was taken to Hamilton Circuit Court is not reversible error in that no objection was offered by ( the defense at the time of the trial. Defend “Dying Statement” It is pointed out that by proceeding Stephenson acknowledged jurisdiction of the court. Especially was this true when he made an appeal to be admitted to bail, the brief points out. All objections and matters of error set forth in the large brief filed by Stephenson attorneys are met with counter argument by the State. One defense contention is that the statement of Madge, Oberholtzer, Indianapolis girl, whom the former Klan dragon was found guilty of slaying and sentenced to life at the Indiana State Prison, was not admissible as a dying statement as it was taken two weeks before her death. Bu Times Special GARY, Ind., Nov. 18.—Police here are investigating the story of Arthur McKenzie, 14, who says he was kept captive and overworked on a farm south of the city since his disappearance Aug. 20. The boy’s mother, Mrs. Priscilla McKenzie, found him on the farm of Edward Wright, whom he says he met the day he left his home. According to the boy, he and Wright agreed that the former would help with work on the farm. The boy asserts that since that time he was kept a prisoner, compelled to do a man’s work for which he was paid $3, and was poorly fed.

LAKES CLEARED OF KILLER FISH Gar Leads Predatory List Removed by State. Several thousand predatory fish have been removed from Indiana lakes by the State Conservation department, according to Superintendent George N. Mannfeld of the fish and game division. In the annual report It is pointed out that game wardens removed 1,958 gar, 332 dogfish and sixty-eight large carp from twelve lakes and one stream. Gar killed averaged 4 pounds and dogfish 7. The largest gar weighed 14 pounds and was long. The largest dogfish weighed 15 pounds. Fish Lake, in Steuben county, provided 338 gar and eighty-eight dogfish. A total of 235 gar and three dogfish was taken from Clear Lake in the same county. The largest single day’s catch was fifty-seven gar taken from Clear Lake. The twelve lakes from which the fish were taken were Wawasee, Gage, Big Long, Clear, Winona, TriLakes, Fish, Shipshewana, Manitdu, Ridlnger, Loon and Bear. Wardens also worked in Deer Creek, Putman county, and were very successful, Mannfeld reports.
