PARENTS GIVEN - GIRL; HOSPITAL SUEDJDR BOY Father Will Fight Case to Highest Court; Doctors Call It Mistake. By United Prett CLEVELAND, Ohio, Sept. 14. A mother and father who believe they became the parents of a boy today stood ready to carry on their legal fight against hospital authorities who claim the infant was a girl. Sam Smith, 45-year-old father, testified before Judge Carl Weygandt yesterday that a baby was born to his wife three weeks ago and that physicians told him at the time it was a boy. Judge Weygandt, called upon to decide whether a substitution had been made, continued the hearing until later in the month, so a nurse, Miss Ruth Meyer, could return from a vacation and testify. Miss Meyer was present when the baby was born. Will Go to Court Smith told the United Press his story in detail today and said he would carry the case to the highest court in the State if necessary. Smith was shaving a man at his (barber shop on the day the baby was born, he said, when a hospital doctor telephoned him congratulations on being the father of a ninepound baby boy. He finished shaving the customer, closed his shop, and went to the hospital. In the maternity ward nurses told him the baby was a boy, he continued, and showed him she marker, “male,” on the infant’s arm. Wife Given Girl "A week later I visited the hospital again and found my wife crying,” Smith said. “She told me the nurses had brought her a baby girl.” “I’m fighting this case to make sure there was no substitution,” he said. “If it can be proved to us that the girl is our baby, that will be the end of the matter. “Meanwhile, the worry is causing my wife days of unnecessary illness. ‘Gyp’ Is Huge NBA Service PHILADELPHIA, Sept. 14. The American motoring public is taken in to the tune of $50,-000,000-annually by the operators of “gyp” automobile clubs, according to Ernest N. Smith, general manager of the American Automobile Association. A drawing card to these clubs usually consists of free or small rate insurance, free towing and low cost accessories, and is usually presented by a “high-powered” salesman.
