BIRGER MUST . DIE; REIGN OF TERROR ENDS Southern Illinois Gang Lord Sentenced to Death for Mayor’s Death. Bn Unit est Press BENTON, 111., July 25. Peace came today to southern Illinois—noted for its Herrin, its riots, Its murders, its feuds, and its gangs—as news tricked through the district that Charley Birger, most recent of Its gang lords, faces the death penalty. * Birger was found guilty of plotting the murder of Mayor Joe Adams of West City and his penalty was fixed by the jury at. death. Two of his companions. Art Newman and Ray Hyland, were convicted and their penalties fixed at life in prison. As chief of the deadly gang which bore his name, Birger has been one of the most feared men in the district. With his passing—and with his foremost enemies already in prison for mail robbery—it generally was agreed that southern Illinois’ reign of terror has come to an end. Law Back in Saddle “This verdict means the end of the reign of the machine gun and restoration of supremacy of the law,” Attorney Roy C. Martin asserted shortly after the verdict was returned Sunday afternoon. Attorneys for Birger and his codefendants at once filed motions for 8 new trial and Judge Charles Milder set Wednesday as the date to hear their arguments. Robert E. Smith, chief counsel for Birger, announced he would carry his appeals to the United States Supreme Court if necessary. Smith has defended 181 persons charged with murder and Birger is the first to receive the extreme penalty. "This case will go to the Supreme Court,” Smith declared. “But if in the end Charley Birger must die, I fun sure he will go as he lived—fearless.” Knew No Fear That Charley Birger lived a life unknown to fear few who knew him will deny. Although he always was protected against the wrath of his enemies, he walked boldly down the streets of almost every southern city and defied even the law of the State to cross his path. His armored fortress, "Shady Rest,” was a bulwark against his enemies until finally it was bombed by an airplane and set afire. Its walls were equipped with machine guns which often showered volleys of bullets at approaching foes. Outcome of Feud The murder of Mayor Adams was ut an incident in the long and bitter feud that existed between Birger's gang and the rival gang headed by the three Shelton brothers—now serving long terms in the Federal penitentiary at LeavenWorth for robbing the mails. Mayor Adams was believed to be friendly to the Sheltons, sufficient in itself to be considered a crime by .the law of the Birgers. And so one night last winter Mayor Adams was called to the front door of his home in West City and shot to death. ORDERS PLANE MOTORS Moundsville Corporation Gives Conti* for 25 to Local Firm. Bit United Press NEW YORK, July 25.—Preparations were hurried by city authorities and the transit companies today to meet a threatened strike emergency, which, if materializes fully, would almost tie up the city. A group of subway employes working for the Interborough Rapid Transit Company has set the strike for midnight tomorrow in protect against the company’s refusal to recognize their union. The Amalgamated Association of Street and Electric Railway Employes, directing the threatened strike, said it would be 100 per cent effective on the two vast subway systems, the elevated lines and the Brooklyn surface lines, That would entail a strike of approximately 25,000 men. The Interborough, however, insisted the disaffected employes are a minority and prepared to keep its lines running. Emergency employes are being brought into the city.
