PROBE LEGALITY OF TWO DEPUTY JUSTICES HERE Thirty-Five Couples Wed at ‘Marriage Parlor’ of ‘Assistant.’ The Marion County prosecutor's office today began investigation of alleged usurping of justic of peace power by Indianapolis individuals. The investigation grew out of appointment of Isidor Wulfson as justice of the peace pro tem, by Edward L. Dietz, only qualified justice in Center Township. The State law which abolishes all but one justice went into effect Jan. 1. Prom that time until March 17, Dietz, acording to records, was the only acting justice in the township. On that day appointment of Wulfson was filed in the county clerk’s office. Seven in One Day On March 18 Wulfson performed a marraige ceremony for Frank J. Long and Amelia Lowry as his first official act. He followed on March 19 with four more marriages and then on March 21 performed seven. The Indiana law provides that a legal justice of the peace piay appoint a “pro tem.” in event of his incapacitation and that such appointed justice may not serve more than sixty days out of any one year. Records show that Wulfson performed a marriage ceremony for Burnell Edgar Murphy and Leemie Easter Edwards on May 28, thereby carrying the term of his appointment over a longer period than sixty days. Performs 35 Ceremonies Wulfson performed thirty-five marriages from May 27 to June 27, according to the records, and Dietz performed seventy-two ceremonies. In many cases marriages performed by Wulfson appear on record books on the same date as those performed by Dietz, indicating that Dietz was not incapacitaed during Wulfson’s work. Dietz said he interpreted the statute to mean he might appoint a “pro tem.” during times when the public would be benefited by the appointment. The statute says nothing about “benefit to public.” Has Two Deputies "I have been ill much of the time,” Dietz said, “and had to have someone to care for the work. Therefore, I appointed Wulfson and Walter S. Glass to serve for me.” Glass has a sign advertising himself as a justice of the peace, in the same building with Dietz, at Delaware and Court Sts. Wulfson’s offices are on Court St., between Delaware and Pennsylvania Sts., and his sign advertises ’’Marriage Parlor.” Over the door of his office in the building is another huge placard, an American flag draped about it, showing the words, “Marriage Parlor.” Claims Legal Appointment Wulfson denied acting without power, saying that he had been appointed legally. When shown the statute’s sixty-day clause he said he had not worked consecutively for sixty days. He said he thought the statute meant only the total of days during the years he actually acted as a justice.The statute reads, “may serve any day or any number of days, not to exceed sixty days, in any one year.” Wulfson said he had presided over Dietz’ court during his appointment, but only at such times as Dietz had been unable to appear. Dietz said he also had empowered Glass to sit in his court. FALSE IMPRISONMENT SUIT SEEKS SIO,OOO Hiram Brewer of Mitchell Acts Against B. & O. Railroad. Bv Times Special LOOGOOTEE, Ind., June 29. Suit for SIO,OOO damages for alleged false imprisonment is on file against the Baltimore & Ohio Railroad Company and two of its employes. Jack Vinson and Harry Chess, with Hiram Brewer as plaintiff. The case is a sequel to an attempt to hold up the B. & O. agent at the station in Shoals a month ago. Brewer was arrested May 29 in connection with the attempt, but was released the next day. He alleges that while he was in jail at Shoals, two railroad detectives, W. V. McGuerty and E. C. Faith threatened him with the "third degree,” if he did not confess to the hold-up attempt. After being freed, Brewer asserts he asked the railroad agent at Shoals for transportation back to his home in Mitchell, but this was refused and he “bummed” his way back. FINANCIER IS CONVICTED C. C. Alfred Found Guilty of Securities Law Violation. Chief Earl Coble of the State Securities Commission announced Wednesday that conviction had been escured in Case Circuit Court, Logansport, Ind., of C. C. Alfred, charged with violations of the securities law. Alfred was charged with giving false information to the commission in regard to the Brazos Development Company, a $1,000,000 stock selling scheme, with assests consisting of a leased gravel pit, Coble said. 1909 Charter Just Registered Although organized and incorporated back in 1909, the Odd Fellows Home, Greensburg, Ind., Tuesday registered in the Secretary of State’s office for the first time. When it *** found there was no such registration, officials brought in the charter. In 1909 incorporators merely filed at the county seat.
