The charges, filed here Thursday by United States District Attorney Albert Ward, allege Foncannon allowed Federal prisoners, supposedly •incarcerated in the Vigo County jail, td roam Terre Haute streets. The prisoners were prohibition law violators who had been sentenced by Federal courts. A precedent in the case has been established in Cook County Illinois, where Sheriff Peter M. Hoffman and some aids were convicted of contempt for allowing Terry Druggan and Frankie Lake, “beer barons” to roam the city while serving Federal jail sentences. The charges include the names of

several prisoners, among them being Bert Fisk, Leslie McKinney, James Locke and Frank Meharry. The complaint filed here by Ward follows an investigation conducted by James Browning, prohibition agent, working under the direction of George H. Winkler, Indiana prohibition chief. Besides charging that he has seen Federal prisoners, supposed to be in jail, roaming the streets, Browning said he had interviewed Terre Haute citizens and found that many ofthem “had seen prisoners roaming about the streets.”
