BOARD AGAIN IN BUILDING CLASH Heads Seek to Learn Authority Extent. The park board has renewed its fight to determine its authority to regulate business buildings within 500 feet of a boulevard. The board today was to consider the case of Frank Woolliifg, whose (low famous filling station permit •was obtained after Circuit Judge Harry O. Chamberlain threatened Building Commissioner Bert Westover with contempt of court charges if a permit were not issued. Woolling was refused a permit by the park board and board of zoning appeals. Motorcycleman Harold Edwards was ordered to stop eVection of the filling station by Woolling’s contractors early Wednesday and the order later rescinded, until the board further considers the matter. An arrest as a test case was considered. Superintendent Walter R. Jarvis was ordered by the board on May 12 to instruct park policemen to prevent business buildings within 500 feet of a boulevard. Park Board Secretary Clarence Myers learned that Woolling had obtained from the city engineering department a permit to cut curbing which had been denied by the park board. Workmen in shiftstoiled through the night to beat the next park board move. Cherries on market Southern Indiana Fruit Makes First v 1927 Appearance. Home-grown cherries made their first appearance of the season at the city marhet today. They are from the southern part of the State, selling at 20 to 25 cents a quart. A scarcity of mushrooms has caused the price to advance to $1.25 a pound, while peaches, which came •on the stands last Satur' :y7'dropped 5 cents to 30 cents a basket. ■ Long wa( • colons are cheaper than when .hoy arrived nearly two weeks ago. They have dropped from $2 to $1.50 and the large round melons are now being offered at the same price. Appeals has decided. The Secor hotel of Toledo, alleged obsolescence of good will for 1919 in the sum of $100,611.40. After July 1, 1919, the opinion sets forth, the “tax passers’ bar lost the patronage of those who came for the purpose of obtaining their favorite beverage. The bar, together with the fixtures, were used for other purposes than the sale of liquor.” In this decision the Government officially decided the bar was conceived to good fellowship in the old days.
