JUVENILE JUDGE ASKING DAY IN ► HIGHEST COURT Ben Lindsey Seeks Ear of Supreme Tribunal of United States. Mu United Press WASHINGTON, April B.—'"America's moat famous judge” has asked ‘.for a day in the nation's most famous court. Ben Lindsey, the kids’ judge of has asked the United States Supreme Court to help him keep his •job as Denver Juvenile judge which he held for twenty-six years, until ousted Jan. 24, by the Colorado Supreme Court. • There’s a singular irony iri Lindsey’s petition. Although he has been famous the world over for insisting that ornery youngsters have their day in court, he claims he was never given one to defend himself. Fought By Klan In 1924 Judge Lindsey and Royal C. Graham, his Republican opponent, waged a terrific campaign for the juvenile judgeship in Denver with all Lindsey's antagonists, developed in twenty years of strenuous career in office, arrayed against him, including the Ku Klux Klan. B For many weeks the election result was in doubt, Lindsey finally being declared elected by a vote of 44,551 to 44,434. Graham contested the election in the District Court claiming fraud in one precinct that if allowed would befeat Lindsey. This court finally decided that Lindsey won by a margin of thirty-five votes after a recalculation. Lindsey’s Case Lindsey's attorneys claim they were denied tha privilege of refuting fraud claims, the court holding this was unnecessary, as his contestants hand failed to make out a case. The case was appealed to the Colorado Supreme Court, Graham dying in the meantime. This higher court ruled that the questionable precinct lie thrown out and ordered Lindsey ousted. Behind the case there rages a long battle of personalities and social policies which give promise that Judge Lindsey' will tell an interesting story if allowed to go beyond the legal facts in getting his day in the "United States Supreme Court. v
