Dr. Todd said he believed that opposition to the city manager appropriation measure was only getting votes for the manager plan. “Let the people have what they want,” Todd declared. Moore interrupted: “This is putting the wagon befoe the horse. Monday is plenty time to act if the petition is filed. We don’t know it will be.’’ Whereupon Boyce cited that the law allowed five days for examination of petitions and that additional clerical help would be needed. He declared the ordinance was recommended by City Controller William C. Buser and was "regular.’’ Boyce Retorts “It isn't the city council's fault the clerk hasn't enough funds or assistants,’’ advised Dorsett. Following the vote Raub declared "this is peculiar conduct for a group of representatives of taxpayers. It is only fair the clerk should have funds to conduet this check as required by statute." Ham and Eggs Sergeant Clifford Richter and two j patrolmen found Moore, ox-council president, eating breakfast—ham and eggs—when they arrived at his home, 1626 Spruce St. Richter handed over the subpoena and told Moore to finish his breakfast. “It says get the body and I want the body in good condition,” said Richter. The sergeant sent the other officers back to headquarters in the police flivver and rode to city hall in Moore's car. While he waited for Moore to finish the ham and eggs he played with Moore’s daughter, 3. Councilman Bartholomew, 1256 N. Senate Ave., was in bed when Sergt. Frank Reilly and squad arrived. Bartholomew dressed hurriedly and was the first “captive" councilman to arrive at the hall with his police escort. Sergeant Reilly loudly read the return on the subpoena to Council President Claude Negley and City Clerk Boyce. The “captive" councilmen were in a good humor and treated the matter as a “great joke.” “Hello there, little one,’’ Bartholomew greeted Sergeant Richter, when he, one of the police department giants, arrived with Moore.
Not Movie Ordinance It wasn't faliure of Negley to include the ordinance prohibiting erection of a theater within 500 feet of a chureh that prompted the councilmen to balk, Moore said. “Bob McNav isn't bossing this council,” said Bartholomew. Both said they wanted Negley to include all ordinances, including the measure appropriating city gas tax funds for street repairs, in the meeting call. Sergt. William Cox brought in Councilman Albertson, 2923 N. New Jersey St. Albertson was the last to arrive. Sergt. Edward Deeter brought. Councilman Dorsett, 1213 N. Kealing St., and Sergt. William Deever arrived with Councilman Millard W. Ferguson, 317 N. Holmes Ave. Not Expected Nobody had much faith that the horsemen were going to show up when the call for the special meeting was issued Thursday morning. At 4 p. m. Thursday “silently one by one" the four horsemen climbed the back stairs to Mayor Duvall's private office. The mayor doesn’t think much of the city manager plan. They were still there, or had gone down the other back stairs when everybody else got hungry and left city hall. At $.03 p. m. Thursdaj', President Negley called council to order. Besides the president, Councilmen Austin H. Todd and Edward B. Raub sat in their seats. City Clerk Boyce and Sergeant-at-Arms Claude McCoy, a group of newspapermen, and five spectators took up the vigil. Negley told McCoy to try to find Dorsett at his barber shop in Wabash St. While they waited Councilman Raub remarked: “This will make 20,000 votes for the city manager plan. I only hope that all of us are put out when the plan is voted through. This is not only enough—it is too much." “Yes,” rejoined Dr. Todd. "This will make plenty of votes for the k-ity manager.” The long wait was enlivened by the Police and Firemen's Band, which was practicing the “Miserere" in the board of works office downstairs. At 8:22 McCoy returned and reported: All Dark “Mr. President, Mr. Dorsett’s barber shop was dark. I could not find him. I even rattled the door and looked for him in the restaurant close by.” The council took his word. It had been verified by a squad of plain olothesmen, who had followed McCoy. Negley handed McCoy a sheaf of subpoenaes for all the absentees and the entire party betook themselves to police headquarters. A squad under Sergt. Patrick O'Connor waa assigned to aid.
