WHAT STATE PAPERS SAY ABOUT THE DEARTH CASE
Comment upon the seizure of the papers and person of thirtye-ight newsboys by Circuit Judgo Clarence Dearth at Muncie, in Indiana newspapers, follows:
The Rushville Republcan—George R. Dale of Muncie is just a common, ordina'y newspaper man. He publishes a Democratic weekly paper, and he never made much money at it. When he began to reveal the conditions in Muncie, reeking with political corruption, he aroused the Ire of Judge Clarence R. Dearth of the Delaware Circuit Court. Dale was sentenced to the penal farm for contempt and appealed to the Indiana Supreme Court. The high court held, in effect, that the “truth is no defense,” and sustained the sentence. Dale made an effort to appeal to the United States Supreme Court, but his appeal was thrown out of court because it was not printed. Dale went to Washington himself to endeavor to get a ruling from the highest court in the land, and while away, Judge Dearth assailed Dale for an anonymous article printed in Dale’s paper and announced that he would again he cited for contempt of court. Clell Maple, former Rush County recorder, who has resided in Muncie for several years, announced he was the author of the article attacking He was a great admirer of the Judge, he is quoted as saying, when the judge made fine speeches at Ku-Klux Klan meetings, but has since changed his mind because performance did not measure up to promise. Dale is returning from Washington and will make a triumphal entry into the old home town Saturday. He will be greeted by his friends, who have at last awakened to the fact that he is being persecuted in espousing a cause for the betterment of the whole community. Thus Judge Dearth by his foolish show of power, some of i*iich it is claimed he did not possess, is making a martyr out of common, ordinary newspaperman, who saw his duty and performed It. Muncie seemed willing to persiit the continued persecution until the judge called thirty-eight newsboys into his court, took copies of Dale’s paper from them and threatened them with harsh treatment if they distributed any more issues of the publication. Without trial, without hearing, without notice, without any right whatever, the judge sought to protect himself by use of power delegated to him by the people for the protection of their rights—among them the right of free speech and a free press. The developments in this case will be commented upon at length not only in Indiana, but throughout the United States. Newspaper trade publications have commented at length on tho Indiana "Supreme Court decision, because it r&ised anew question that should he settled by the highest court in the land. It should be determined, once and for all, whether the court can be prostituted as it was when newspapers were forcibly taken from innocent carrier boys without hearing. If this procedure is permitted, no newspaper is safe, and the rights of a freo press are in dagger. Porte Herald Argues: Judge Clarence W. Dearth of Muncie believes that if a newspaper publishes something about, him that he doesn’t approve he can have the newsboys distributing the papers arrested and their copies confiscated. Judge Deartii is the man who has been engaged in a hitter legal struggle with George R .Dale, editor of the paper, who the judge claims made libelofis statements about him and his qourt. The Judge imposed a fine for contempt of court on Dale aifd the latter lias Just been granted a rehearing before the United States supreme court on his appeal. Down in Muncie they are trying to Impeach the judge, who apparently has forgotten that a constitution exists. One Indianapolis paper called him the “Mussolini of Muncie” and such a title isn’t far amiss, for the dictator has done just that very thing in Rome, seized newspapers and ordered them suppressed. In a land founded on the freedom of speech as one of its most, precious gifts, the action of Judge Dearth Is tyrannical and medieval. Ho has become obsessed with the Idea that he, the court, Is above criticism: he has taken the theory that “the king can do no wrong” to his bosom, and is trying to impress that theory upon an enlightened community. If any higher court upholds his action in prohibiting the newsboys from selling papers and confiscating the copies, a severe blow will have been dealth constitutional rights in this country. The Grecnsburg Evening Times: The Indianapolis Times Is leading a valiant fight for freedom of speech, and freedom of the press as guaranteed under the constituUons of the United States and tho State of Indiana. Tho paper's immediate objective is the curtailment of judicial power as exemplified in tho case of Judge Clarence Dearth of Muncie, whoso seizuro of -Copies of George Dale's newspaper, the Post-Demo-crat, and his unprecedented herding of thirty-eight newsboys in his court room without due process of legal arrest have aroused the wrath of not only Muncie citizens hut that of many others over the State. Under tho threat of judicial reprisal, many newspapers which cherish the liberty of the American press liavo refrained from tho expressions on Dearth's acts, "but not the Indianapolis Times. With a mil-lion-dollar ‘‘libel” suit already on its hands as the result of Ku-Klux exposures—other Ku-Klux activities, it may be said—this Indianapolis paper was one of those which came to tindefense of Editor Dale when he upset the vials of wrath at Muncie, the i Kluxers’ stronghold. It has no morel fear than has Dale of affronting judicial tyranny and indeed tho finaneial nnd journalistic bucking of The Times may well he devoted to clearing up this muddled matter of court power abuse. Tho Indianapolis Times continues its demand that tho Legislature impeach Judgo Dearth. An editorial explanation of its policy Is given. The Princeton Evening Democrat: The news dispatches of Thursday give an indication of what is likely to happen to Judge Dearth. Petition* are being circulated in Muncie by many prominent citizens and, according to the dispatches, are being generously signed, which have for their purpose the Judge's impeachment. The charges are that ho caused to be arrested some thirty-eight newsboys who were selling copies of a paper that nad in it certain criticism of tho judge and the mayor of Muncie. Judge Dearth and others in Muncie have been riding a “high, wide and handsome” vehicle for sonic time. George Tt. Dale, publisher of a weekly newspaper In that city, has seen fit to criticise the judge and mayor of that city for certain acts and In this connection Dale was cited for contempt of court.
