ROOKER EXPLAINS WHY HE DID II PAY DALE FEf Local Attorney, in Statement, Says It Was Not His Duty. Admission that William V. Hooker, Ipdianapolis attorney, did not pay the United Stntes Supreme Court clerk the necessary deposit to cover costs of presenting the appeal of George It. Dale, M uncle newspaper publisher, was contained in a ntntement by Rooker today accompanied by the declaration that “It waa not my duty to pay them.” Rooker’s statement was In answer to press reports of the brief filed tor Dale by Moses E. Clapp, former Senator from Minnesota, now Dale’s attorney. The brief set out that Rooker had failed to pay the required fees necessary to cover the cost of presenting the appeal which was lost. Rooker’s statement follows: “Press dispatches from Washington carry an equivocal statement by George R. Dale in respect to the nonpayment of tlie clerk’s expenses of printing the record in Dale’s case. It is true I did not {A? those costs. It was not my duty to pay them. It would be Mr. Dale's misfortune if ho has attempted to havo the Supreme Court believe that I was ltnquent in any duty to Mr. DulW That would require me to place all the papers and letters in the case in the hands of the court. I retired from Mr. Dale’s case In early October. He was advised thon that these costs were not paid. I was succeeded, I am informed, by John W. Davis. Now it seems Senator Clapp is Mr. Dale's attorney. l shall inquire of the court ns to its impreesion and act accordingly.”
