their program of exchanging oil leases for titles. Old Spanish Code Not only the 1917 Constitution, but -very Mexican enactment decrees that the sub-soil minerals belong to the people. The old Spanish code, adopted by Mexico in 1842 and codified in 1884 even before Diaz, declared that no foreigner may exploit the minerals of the sub-soil in the regions twenty leagues from the bordef. Inasmuch as virtually all the oil lands held by Americans are within this radious the Mexicans hold that the titles held by American oil companies are, In fact, illegal today. They declare that, in offering to exchange legal fifty-year leases for illegal titles, they are conferring upon American investors actual rights for fictitious ones. “Why has the Mexican government voted to exchange a legal right to exploit its sub-soil for titles based on illegal transactions?” one I official was asked. Two Reasons ‘‘For two reasons,” he replied. “First, we feel that if the government took legal steps to recover its property the small stockholders in American companies would suffer losses. Next, we realize that properly regulated exploitation of our sources is beneficial to Mexico, as I well as to the foreign investors.

Then, of course, all question as to actual ownership is settled. “The question of royalties is not Involved. None of the oil companies except tli£ Huastcca (Doheny) Company, owns the surface lands. They will continue to pay royalties to the owners of the surface land. Neither is the tax question involved. It is merely the determination of final ownership and our government’s right of eminent domain. And this right is being exercised according to, not only eVrry Mexican law, but every tradition of our forefathers. Furthermore we consider that, far from injuring American oil companies or doing them injustice, we are establishing \heir right in law for the first time. We are exchanging for an immoral ami illegal possession, a moral and legal one. Accept Challenge The majority of foreign oil companies have accepted the exchange proposal. The British and Dutch companies (“Mexican and Eagle” and “Corona”) have agreed to the terms. Among the larger American companies to have acceded without protest are the International Petroleum Company, Seaboard Company; East Coast (Southern Pacific); Transcontineneal (Standard Oil), Texas Oil Company of Mexico, the Daugherty interests (involving $300,000 investments), Gulf Coast, Empire Pipe

Line and otliers. The companies accepting Mexico’s terms are 63 per cent of the total. Those refusing to sign up by Jan. 1 were the former Bolieny interests and their subsidiaries, now owned by the Pan-American Petroleum and Transport Company, supposedly a Standax-d Oil concern; the Mexican Gulf (the Mellon family company); the Marian Company anl others. The value of American and British oil investments in Mexico total $1,200,000,00. but it is said that oil resources fierce have just been tapped. It is estimated that 85 per cent of Mexico’s oil wealth still remains intact. While 1,300,000 barrels have been taken out there are said to be some five million barrels left.
