Pickens today mailed letters to all members of the Indiana State Bar Association asking their vojes on proposed revisions in criminal laws, drawn up by the committee on criminal jurisprudence. Those proposals favored will be submitted to the Legislature. All votes must be mailed to James J. Robinson of the Indiana University law school by Jan. 6. The association board of governors will meet Jan. 8 to count the vote and prepare the approved revisions for presentation to the General Assembly. The changes now proposed call for three amendments to the State constitution and amendments to many criminal law statutes. In addition to criminal code changes, the bar asociation Is seeking to have a nonsalarled State crime commission established which would have all officials, concerned with the administration of Justice, turn In regular reports on crime. At this Attorney Moore advanced and said: “In view of the fact that Stephenson Is now In the Jurisdiction of this court I ask that he be confined in the local police station so that we may consult with him. We cannot see any cause for harm In such an action. He will be securely confined.” Warden Daly stopped forward and shook his head in the negative. ‘There Is no necessity for that,” said the judge. “I cannot conceive of such an action. If It. is necessary for you to consult with him I am sure that you will be given every opportunity at the prison.” Moore remarked that the Stephenson lawyers had only been permitted ‘‘smattering talks" at the prison and had had no time to ‘‘go over matters.” Back to Prison The court ruled that Stephenson go back to prison. The guards loaded him Into the prison automobile and rushed him back behind bars. He had been outside a scant half-hour. While the brief session was-going on In the courtroom Stephenson Indifferently examined papers before him and whispered now and then with Attorney Newman. He had a healthy color and appeared as well groomed as he did when he was taken to prison from Noblesvllle In November, 1925. The prison guards were careful not to let newspapermen get within talking distance of Stephenson. No reporter has been permitted a word with Stephenson since the day last October, when Stephenson managed to smuggle his famous series of letters boasting he could expose corruption In official Indiana, and three Indiana cities If given proper opportunity. While the principals were In the courtroom John Moorman, one of the prison trustees who have helped Governor Ed Jackson keep newspaper men away from Stephenson, conferred with Daly. He also exchanged greetings with Remy and Kane. The original petition for the habeas corpus writ merely alleged that Stephenson was Illegally Imprisoned. The amendment specifically set out that the Imprisonment was Illegal because the Marlon County clerk failed to sign the transcript upon which the Oberholtzer murder case was transferred from Marion Criminal Court to Hamilton Circuit Cohrt at Noblesvllle. This necessitated the conference of the State attorneys upon what move to make next. One of the attorneys for the State made the remark that "This Is the first step In the effort to make good on the promises given Stephenson for his silence.” Attorneys There Gllllom, Kane and Remjr arrived Tuesday evening and completed their preparations for today’s battle. Hill and Klpllnger arrived earlier Tuesday, conferring with Robert H. Moore, Stephenson's attorney in Michigan City. Prosecutor Louis E. Kunkel of Michigan City Is assisting the attorney general. From authoritative sources It was learned that Stephenson still Is employed In the prison chair factory. Judge Crumpacker is finishing his third four-year term In the La Porte Superior bench and was reelected for a fourth term, to begin Jan. 1. Ho has heard practically all the pleas for writs of habeas corpus for prisoners In the State Prison during the last twelve years and had denied all of them. The Michigan City police department had four officers on duty In the courtroom. Brief Ready The brief supporting the motion to quush the original plea, which Gilllom had prepared to file before the Stephenson attorneys filed their amendment, declared “the habeas corpus statute of Indiana (Sec. 1200, Burns, 1826), provides that no court or judge shall Inquire into the legality of any Judgment or process whereby the party Is In his custody, or discharge him when the term of commitment has not expired, upon any process Issued on any final Judgment of a court of competent jurisdiction." The brief set forth that the Hamilton Circuit Court, where Stephenson was given a life sentence for murder, Is a court of scornpetent jurisdiction and “the legal presumption arises that the said court had Jurisdiction of the person of the petitioner and of the subject matter of the offense for which he was tried and that,a valid judgment was rendered by It as a court of competent jurisdiction. Every presumption is in favor of a Judgment which Is collaterally attacked.” Several Supreme Court decisions were cited to support* this contention. “The only averrment made to overcome this legal presumption of Jurisdiction Is the statement of the legal conclusion that the said court did not have Jurisdiction of person or subject-matter. No facts from the record are alleged to support this statement of legal conclusion. The presumption of jurisdiction can only be overemoe by averring facts from the record to the contrary,” the brief continues. It then launched into an el&bora tlon of statement to prove that these contentions weer well founded.
