FICKLENESS OF FEMININE HD IS BEFORE JURY Woman Charged With Poisoning Husband, Jilting Lover. Bii XFA Service GOSHEN, N. Y., Dec. 10.—Those who sing that “woman is fickle” will find prime jurisdiction in Mrs. Lucy Baxter Early here —provided the prosecuting attorney proves his case against her. The State’s theory is that she poisoned her husband for love of another man and then fell out with the other man in a quarrel over $12 —and the other man from his jail cell let out the tragic mystery. That theory is not proved yet, Mrs. Early—36, maternal, and cheerful—waits in the jail for her trial that is to come up before Christmas and protests her innocence. Not Worried “It doesn’t worry me in the least,” she told a visitor. “It’s seldom that circumstances alone can convict an innocent person. I don’t believe they can prove what I haven’t done.” But the circumstances can be pieced 'together into a fascinating triangular love affair —a tragedy of unhappy wifehood and release through poison, an adventure of roadhouse operation and clandestine rendezvous, a final jeering twist of fate by which the ashes of romance brought disclosure. The other man in the case is 'William Wegley, 31. He had been an

Wegley had snatched her purse and taken sl2. From his jail cell, the Incensed 'Wegley began to talk. He said that he and Mrs. Early had begun meeting and carrying on a furtive love affair last winter. Then, he said, he had bought rat poison for Mrs. Early at her request. Well, the woman's husband, Daniel Early, 49, working in a factory, and veteran of the Spanish-American and the Great wars, had died last March of a mysterious stomach complaint. After Wegley started talking, the district attorney had Early’s flagdraped coffin dug up and found his body was saturated with arsenic. Exposed By sl2 The prosecutor says he can prove that Mrs. Early quarreled with her husband, that she gave him all his food and medicine during his illness, that she and Wegley conducted a love affair before and after Early’s death. And this whole shocking theory of secret guilt was dragged into daylight as a result of the fnsignificant quarrel over a purse containing sl2 in the automobile that summer evening. The basis of the prosecution, of course, is the supposed changeableness of woman. The defendant, the jury will be asked to believe, wearied quickly of both husband and sweetheart. Mrs. Early, for her part, says that all her love Is concentrated on two very young men, her children, Daniel, 11, and Kenneth, 9. BOY ESCAPES BOUT NEW CASTLE, Pa., Dec. 10.—Ray Shoaf, 13, was unhurt recently when the pony he was riding was killed by electricity. The boy says that as he rode past a pole the pony fell and he leaped to the ground. Thinking his pony had tripped he went to get help. Men found that the body of the beast was charged with eelctricity. It is believed the saddle and the boy's rubber shoes saved his life.
