A license, permit or franchise conferring the privilege of doing a public utility business, is. under our statutes, just as much personal to the particular corporation as is its own charter From the fact that the indiananolis l.’ght and Heat Company and the Merchante Heat and Light Com pauy are each willing Io part with their license, franchise and Indeterminate per init. it does not follow that tho State will consider tho Indianapolis Dower and Light Company a suitable entity or oor poration to take over and exercise alien license and permit. In s(her words it does not follow, as a. matter of course, that the new company will bo privileged by the state to operate a public utility even though it. wants to do so. The Stato reserves the right to confer or not to confer the privilege of operating a public utility. And. therefore, the privilege must he obtained as preliminary lo any further step.
