Justice Taft, the court asserts that the commission has authority merely over stock ownership. “The Clayton act," says the court, “has no application to ownership of a competitor’s property and business prior to any action by the commission, even though this be brought about through stock unlawfully held." The decision means that the commission to dissolve any trust must act before the combination takes place. Once physical properties have been joined the commission is helpless. Dissenting Opinion Justice Louis S. Brandeis, delivering the dissenting- opinion, asserted that the Clayton Act was clearly intended not only “to prevent continued holding of the stock and the peculiar evils incident thereto,” but also “to prevent the peculiar evils resulting therefrom.” The five justices concurring in the momentous decision admit its import in discussing one of the cases considered: "As all property and business of the two competing companies were acquired by the petitioner prior to the filing of the com-
plaint, It is evident that no practical relief could be obtained through an order merely directing petitioner to divest itself of valueless stock." Decisions Reversed By its decision the court reversed lower court decisions and upheld the acquisition by Swift & Cos., of the physical properties of the Moultrie Packing Company and the Andalusi Packing Company, and the acquisition by tlie Thatcher Manufacturing Company of property of three-com-petitors. The Thatcher company now controls from 70 > 00 per c<y*t of the country’s milk bottle manufacture. It must divest itself of all stock of the three former competitors, all of which it has already completely dissolved, but it can retain all property and business assets. Frear of Wisconsin. “Traveled 4,500 miles through twenty Indians reservations this summer,” he explained tolay. “Left the car unguarded every night. Didn’t lose even a monkey wrench. Had I spent that much time in any white man’s city I might have lost the whole car.” Frear, a member of the House Indian Affairs Committee, took the
trip to get first-hand knowledge of Indian conditions. “I was surprised to discover,” he said, “how many prominent citizens In the West are behind the movement to obtain justice for the Indian. The Indian is respected out there.” Frear renewed his attack on the resolution passed by * Congress last March by which SIOO,OOO of Navajo tribal funds will be used to build a tourist bridge across the eastern end of the Grand Canyon.
