ZONING DECISION • OF NATION-WIDE SCOPEJPENDS Indianapolis Would Be Affected by Result. Times Washinaton Bureau. 1322 New York Avenue WASHINGTON, Nov. 23 A little Village, Euclid, Ohio, has raised one ftf the most important constitutional Questions of this decade. Thus James Metzenbaum, prornihent Ohio attorney, summed up today the village’s test zoning case how before the Bunted States Supreme Court for final decision. “The big point at issue,” he explained, “is whether a zoning ordinance, as adoptedi by Euclid four years ago, is basically unconstitutional and violative of both State and federal constitutions. The decision Will affect 30,000,000 Americans how living in zoned communities, or inore than half the total urban population of this nation. It will affect Some 448 towns and cities in fortyone States.” History of Case History of the Euclid case is this: A Euclid real estate company assailed the village’s zoning ordinance and brought suit for a perpetual injunction against any enforcement. The United States District Court at Cleveland ruled that the ordinance was unconstitutional in that it "takes property without compensation.” Metzenbaum, representing the village, appealed to the Unite# States Supreme Court, arguing his case in Washington last January. The higher court asked for a complete reargument, which was delivered. Possible Effect "If the Supreme Court upholds the decision of the trial cburt all zoning ordinances throughout the United States will necessarily fall, the Federal constitution extending to all States,” Metzenbaum said. The decision will affect Baltimore, Denver, San Francisco, San Diego, Indianapolis, Evansville, Terre Haute, Akron, Cincinnati, Toledo, Oklahoma City, Memphis, Omaha, Minneapolis, St. Paul, Seattle, Portland and the District of Columbia, Itccording to Metzenbaum. “Robin Hood's Larder” is a giant tree in Sherwood forest in which, according to tradition, Robin Hood used to hide the deer he had slain.

DINNER TOM OPENIOF HOTEL Expect 1,500 Guests at New Marott. Fifteen hundred guests are expected at the dinner Wednesday night, marking the formal opening of the new Marott Hotel, N. Meridian St. and Fall Creek Blvd. The new establishment is the largest apartment hotel to be erected here, containing 234 apartments. It is fnetropolitan in all respects, having a huge lobby, dining rooms, ball rooms and every convenience. It towers above Fall Creek in an ideal location, free from noise of traffic. A reception is to be held during the afternoon and those who attend will be taken on an inspection tour of the buiding. Tea will be served. The manager of the hotel is S. B.JShireman, who will be host. SEVERALINJURED IN TRAIN WRECK Fast Gulf Special Derailed in Alabama. Bv United Press MOBILE, Ala.. Nov. 1 23.—The speeding southbound Gulf Special of the Mobile & Ohio Railroad was derailed near' Oak Grove, Ala., early today. Several passengers were Injured, but early reports said no one had been killed. Reports reaching here said the entire train, which was en route from. St. Louis to Mobile, left the tracks with the exception of the observation dining car.

GANG HEAD INDENTIFIED Two Confess Attacking and Robbing Man. Police have obtained confessions from two of four alleged to have attacked and robbed John Arnold, 968 Eugene St., Nov. 8. The rumors started here after had taken the witness stand in the trial of the six prisoners whq, escaped and were captured after they had killed Deputy Warden Peter Klein. The youthful slayer was excused from testifying after he had pleaded with the judge that he knew noth-
ing of the murder, and that any testimony given by him would go against him with other prisoners in the penitentiary, “where I’ve got to stay a long time.” He is serving life and ninety-nine years.
