INNOCENT MAN BEHIND PRISON BARSJ YEARS Parole Board Is Unable to Compute Damage Done Him. Bu Times Special CHICAGO, Oct. 22.—How much cash would you take _in exchange for six years of freedom? Would you compute the figurq on the basis of your earning power at so much per year, or is freedom worth as much to one man as to another? These have become important questions to the State of Illinois in its affair with Henry Schmidt. For six years the State kept Schmidt locked up in the penitentiary at Joliet before learning that it had made a mistake; that another man had committed the robbery for which Schmidt was sentenced. Now Schmidt has been given his freedom again, but it doesn’t mean much after six years. He hasn’t any job; can’t get his old one back, and many of those with whom he used to work at a factory have raised themselves to good positions. “Out of Luck” "I guess I’m just out of luck,” the 27-year-old ex-convict said when he came back to Chicago wearing a misfit suit and fingering anew $lO bill—gifts of the State for six years of service. "I hear the parole board wants to do something for me. They acted awfully sorry when they found I wasn’t guilty, but I don’t know how they could pay me back for those six years of punishment.” Hinton G. Clabaugh, head of the parole board, said he and his associates were attempting to find some way to repay Schmidt but that the State provided no funds for correcting its own mistakes. He suggested that a subscription fund be raised to help Schmidt catch up with the six

Now it has been over a. month and I am free of all suffering, and never have an ache or pain of any kind. My hands and arms are just as active as anyone’s. years of freedom that have escaped him. “But, how much should he be given,” Clabaugh asked. “He was earning only about $5 a day when he was arrested and even if he had the equivalent of that salary for six years he wouldn't be much better off.” Convicted of Robbery Schmidt was arrested in the autumn of 1920 on a charge of robbery with a gun. With him were convicted Mike Valina and Andrew' Belg. The latter two told police at the time of their arrest that they had been assisted in the robbery by a man named Smith. Through a police error due to the similarity in names, Schmidt was arrested. He failed to prove a strong alibi and w'as convicted and sent' to prison without ever seeing the two men who had accused him. Then, through some queer twist of fate all three met inside the prison walls and compared notes. Valina w'ent before the parole board and declared that Schmidt was innocent. But even now' Schmidt is not entirely free. The parole board granted him a parole on the basis of Valina's story and this w'ill be in effect until the necessary steps can be taken to get hini a complete pardon. Meanwhile Schmidt is living with his sister here wondering how he w'ill catch up with life after being robbed of the six years that most men utilize for the development of their best talents.
