ASKS DISMISSAL OF DATEAPPf AL Gilliom Goes to U. S. Supreme Court in Editor’s Case. In a motion filcrl today with the United States Supreme Court by Attorney General Arthur L. Gilliom, dismissal is asked of the appeal of George It. Dale, Muncie editor, who carried his fight against a jail sentence to the Nation’s highest, tribunal when the Indiana Supreme Court on contempt charges. In addition to asking dismissal of the writ of oror allowed by the Indiana Supreme Court, Gilliom asks similar action on Dale's application for a writ of certiorari, asserting the maximum time limit for such a writ has expired. Dismissal, of the appeal is asked on the principal ground that the Federal Questions -pale raised before the highest court are not reviewable, having been raised neither in the trial court nor the Indiana Supreme ‘Court. Asa last resort, Dale offered to prove the truthfulness of the alleged contemptuous statements about' Clarence W. Dearth, trial judge. Supreme Court of Indiana held this to be of no avail. NO WORKERS NEEDED Local Red Cross Advised of Sil tuition in Florida Storm Area. A telegram to William Fortune, chairman Indianapolis chapter of the American Red Cross, from national Red Cross headquarters, states that there now is no further need for mechanics and laborers in southern Florida. , \ The Indianapolis chapter today sent an additionalss,ooo to national headquarters for Florida hurricane relief work, making the total thus far sent $20,000. Contributions are still being received. DEATH MINE MAY'OPEN Company Which Has Leased Shaft at Sullivan to Incorporate. Resumption of operations at the City Coal Mine at Sullivan, where fifty-two men lost their lives in an explosion early in 1925, was foreseen today with the filing of incorporation papers at the Statehouse for the Crown Coal Company. Capital stock of the new concern will be $5,000. Incorporators are George W. Carty, Nicholas Fougerousse, Everett M. Ingleman, John M. Lowry, Ola Wilson, Nicholas Rogers and Glean Morgan. Tho company has obtained a lease on the mine, the papers "State. PROPOSES LARGER~ FEE Councilman Deems Woodruff Place Levy Too Low. Payment of $5,000 a year for police and fire protection in yVoodruff Place is deemed a bit IoW by city councilmen. Councilman Walter R. Dorsett, who has advanced rapidly as a majority faction leader recently, is leading the movement to increase the Cost of protection inasmuch as the present contract has expired. Dorsett contends" that the assessed valuation of property in the “town within a townJ* is more than $2,000,000. The council meeting will be Friday night. -
