I.—The Tea- ■ pot Dome case is now practically I without parallel in the history of ■ Federal Courts. One remarkable feature lies in the I wide difference between the opinion I handed down by Judge T. Blake KenI nedy on the Wyoming naval oil reserve leases and that by Judge Paul J. McCormick on the California naval oil reserve leases in which the isses involved and much of the evidence was identical. The two are Federal district judge of equal rank. Kennedy held the Wyoming lease was legal. McCormick said the California lease was fraudulent. On only one of the issues involved did the two agree. Rebuke Unique The ninth circuit court of appeals upheld Judge McCormick’s decision; the eighth circuit court of appeals has just reversed Judge Kennedy, and the rebuke administered to Kennedy in the reversal is unique in its completeness. When the Teapot Dome case was being tried. Government counsel presented evidence to show that five men including Harry F. Sinclair met and arranged organization of the Continental Trading Company and purchase by it of 33,333,333 barrels of crude oil; that part of this oil was immediately resold to the Prairie Oil and Gas Company and the Sinclair Crude Oil Purchasing Company at a profit of 25 ceijts a barrel; that these profits were distributed in the form of Liberty bonds; that some of these bonds were traced to Milton Everhart son-in-law of Secretary Fall; and that the proceeds were used to meet notes signed by Fall and his Three Rivers Land and Cattle Company. On this showing they hoped to prove fraud and corruption in Fall’s lease to Sinclair of Teapot Dome. Evidence Barred Judge Kennedy, however, ruled that bank records dealing with the Continental Trading Company could not be introduced. The Government then traced the money backward from Fall to Sinclair. Kennedy ruled that all this evidence should be stricken from the record. Judge Kenyon, reversing Kennedy, declared' that the Government had sustained its claim and that the evidence stricken out was competent. Kennedy, in writing his opinion, inferred that the refusal of all five men at the orginal conference to testify, the departure of four of them from this country, and the claim of Everhart that he should be excused from testifying because it would incriminate him, cleared Sinclair of any implication of guilt. Kenyon, rebuking Kennedy for this inference, says: “The reason able, proper and natural inferences from the accrual of condemnatory incidents appearing in this record satisfy us of Sinclair’s connection with the Continental Trading Company and the acquisition of Government Liberty bonds by Everhart and Fall. A trail of deceit, falsehood, subterfuge, bad faith, and corruption runs through the transactions incident to and surrounding the making of this lease. It should not receive the approval of the court.” SHOOTING ACCIDENTAL Negro Youth Wounded—Two Women In Jail After Fight. A shooting scrape at Ave., Thursday night, fn which a Negro youth was wounded, was accidental, police said today, following investigation. Emma Handy, of that address, is said to have been playing with a22 calibre rifle. She pointed it at Claude Hayes, 19, Negro, 1601 Northwestern Ave., and pulled the trigger. The bullet lodged in his his neck. Hayes is held in city hospital detention ward on a vagrancy charge. Miss Handy could not be v located. Mrs. Willie Sparks, Negro, 871 W. Twenty-Seventh St., and Miss Evelyn Lloyd, Negro, 429 E. Court St., are in city prison on assault and battery charges. They fought when ortt accused the other of making a report to police about her. CONTROVERSY RENEWED Opinions Vary on Disposition of 17 I,ondon Churches. Bu United Press LONDON, Oct. I.—Controversy has broken out afresh regarding the possible fate of the seventeen famous churches in the heart of London, built by Sir Christopher Wre/. A commission of four bishops has recommended that they be disposed of. The sum necessary to save them, £1,500,000, is declared to be far beyond the reach of the ecclesiastical commissioners. The Roman Catholic weekly, The Universe, urges that if the Church of England can no longer maintain these seventeen churches, some of them be sold to other denominations, and indicates that the Roman Catholics would not be averse to taking over one or more of those historic religious edifices.

One western store quotes prices on monkeys and bear cubs, a Kansas City store advertises “everything from fleas to elephants” and a New York pet shop are featuring baby boa constrictors for $1.75. Regardless of these "freaks” the canary and the dog are holding their own in their respective ranks. One California bird breeder has 5,000 Budgerigars or love birds for sale. This year there are over 1,200 different styles of bird cages so colored and designed that they will be in harmony, with any type of Interior decoration or any color of bird. Chevrolets were second, with 176, and Buicks third, with seventy-four. Higher priced makes, such as Marmon, Stutz, Lincoln and Packard, sold from one to eleven cars.
