It also charged that Hawkins that the case might. be called up against Hosea "and by! means of-p&ins and penalties upofc said Maxwell Hosea, deters said Maxwell Hosea Ifc-om giving her (Miss Brown) that aid and testimony she. is entitled to as a' litigant In this court.” Parts of the complaint stricken out by the judge were. “Plaintiff further says that some of the shots fired by the defendant Hawkinsjind his deputies penetrated the two rear tires of said car, as well as the fender; that after completion of the search, outrages and grievances hereinbefore stated, the said Hawkins announced that he was hunting, for a Buick, but he made/ no claim or pretense that, he then and there or ever had had a search warrant for either a Buick or a rumrunner.” V Miss Brown and companion were riding in a Willys-Knight. “Plaintiff further states after the tires went down on said WillysKnight, as they speedily did, and while it was apparent that the said Willys-Knight could not be used to transport the plaintiff to Indianapolis, she appealed to the, defendant, as it was her right and his duty to respond as to how she would get to tier home*in Indianapolis; apd that although it then apd there, became the dufy of defendant, he hftving in his possession two well equipped automobiles, to have transported her in safety to her home in the city of Indianapolis, the defendatvt and his deputies declared it was no concern of theirs, and it was up to her tcuget to Indianapolis. That at the time \thls last declaration was made by defendant Hrfwkiqs it was about 11 p. m. and had begun to rein; and plaintiff says that by the aid of the good and loyal citizens of Old Augusta she was enabled to reach her home in the city of Indianapolis the next morning about 1 a. m." “Fusillade of Shots” This section of the complaint, which Hawkins asked be stricken out, was left in. 0 “Plaintiff further says that following the fusillade of shots, armed men appeared on both sides of car, pointing revolvers at said Hosea and at the plaintiff, and with oaths and imprecations ordered them to ‘stick ’em up’ and get out of said car. That plaintiff obeyed the injunction to get out of said car.” The allegation kit Miss Brown that was searched “by said armed men by their placing their hands in her pockets and on her person,” was permitted to ’’remain in the coinplaint, but a section was cut out describing the search, which read; “Although a searchlight wa# thrown on her from head to foot, revealing that there was no bulging clothing or anything on her in which bottles of liquor or other contrabandylould be concealed.’ ”

BABY RUN OVER, KILLEDBY AUTO Sister, Holding Child, Falls in Car’s Path. . Mary Rajer, 16-months-old daughter of . Mr. and Mrs. Frank Rajer, 739 Ketcham St., was run over and killed by the automobile of George Scruggs, 766 Ptetchafn St., Friday night as Scruggs backed out of an alley into PSttcham St., near the child’s home. The driver, charged with involuntary manslaughter, was released on his own recognizance. Police were told that the child was being carried by' her sister, Francis, 10, who, with another sister, Rose, 12, and a playmate, Ernestinio Katski, 734 Ketchem St., had been teasing Scruggs by running along his car as he drove slowly south in Ketcham St. When the car'arrived al the alley Scruggs drove in, so that he might hack out and turn around. The childred followed, and when he started to back his machine the Katski girl ran in front of Francis and she fell with the baby. The rear wheel 6t the car crushed the child’s skull. The baby died before police arrived. HAMRICK CASE TO BEGIN Monday and Tuesday Set Aside for Selection of Jury. .. Monday and Tuesday have been set aside for the selection of a jury in the case of Jesse D. Hamrick, local attorney, and his wife, Mrs. llbllla M. Hamrick, v'ho will face trial in Criminal Court <;n a charge of conspiracy to commit arson. The two were indicted with James Eaton, 16, their former Negro house boy, who is said to have confessed to Prosecutor William H. Remy, Implicating Hamrick-and his wife. The two Hamricks are being tried separately from Eaton. The three are alleged to have conspired to burn Hatarick’s home on the Michigan Rd. ne*r New Augusta.
