FLORIDA MAKES 4 PROTEST AGAINST INHERITANCE TAX Claims Federal Law Aimed Only at Peninsular State. Bv Times Snerinl WASHINGTON, Aug. 17.—Portentously citing the Boston tea party and the American Revolution as the sort of thing that’s apt to happen when there’s taxation without repr®sentation, the State of Florida has just filed*a brief with the United States Supreme Cn\irt, demanding the elimination of the present Federal inheritance tax law. It is the Florida contention, made through Attorney General John B. Johnson, that the kederal inheritance tax law, which seeks to equalize such tax collections throughout the country, is unconstitutional because it hits some States harder than others. It seems that it’s particularly hard on the States of Florida, Alabama and Nevada, which have no inheritance tax laws. According to the provisions of the present Federal revenue yiet, as much as 80 per cent of the amount of the Federal inheritance taxranging from 1 per cent on estates of $50,000 to 20 per cent on over $10,900,000 —can be rebated States having similar laws, ™ This, according to the Florida argument, penalizes States having no inheritance tax laws because they can’t claim rebates, and their citizens have to pay the full amount of the Federal tax. Such an arrangement, It seems, lessens the inducement to millionaires to die in Florida because, while /they can escape a State tax, the Federal tax hits their estates with .full force. \Sumi a scheme. Florida argues, makes the Federal tax discriminatory and violates the Constitution of the United States. It is also characterized as a legislative device “to coerce the State of Florida Into Imposing and levying an inheritance tax"—something that can’t be done without violating a provision of the State Constitution forbidding such taxes. “The estate tax provision of the Revenue Act,’’ suys attorney General Johnson, “was not passed for the purpose of raising Federal revenue. It was directed primarily at the State of Florida.” such conditions he asks, “is Florida to sit supinely by and see her sovereignty destroyed?” He avers not ant} suggests a series of dire political consequences which have come from taxation arrangements similar to the one in question. Hurd, consulting engineer of the board of sanitary commissioners, to return for completion of the sewage disposal plant was blocked today hy majority board members at a stormy session. Russell T. MajjFall and City Engineer George G. Schmidt voted to "table for the time being’’ Hurd's request to finish the task, over the protest of O. C. Ross, board president, and representatives of Hurd, including Edwin Hurd, his eon. “I don’t expect to take orders from you," Ross told Mac Fall at one stage of the debate, during which Mac Fall charged Ross with dealing with Hurd without knowledge of other board members. The_ majority members said they would proceed with employment of Fuller and McClintocb, New York sanitary engineers, to Conduct ar. "impartial survey of the entir® situation.” The action followed a bitter warfare between board members concerning affairs at the plant. NUDE BATHING LAWFU^j Burlington (Wis.) Could Not Find Ordinance Against It. Bv United Press BURLINGTON, TVis.. Aug. 17. When several persons recently were found bathing in the nude at one of the city’s beaches it was discovered there was no city statute to prevent the practice. One ordinance read that -bathers could go swimming between 4 p. m. and 9 p. m. only when they were “clothed from neck to knee,” but it made no prbvisioh for the dressing of swimmers at later hours of the night.
