TO SENTENCE 5 FOR RUM THEFTS (Continued From Page 1) cago ace. announced the Government held a signed confession of Marshall to this effect. The confession was obtained by Maroney and given before hitn and C. W. MoPhail, local department of Justice head. Marshall said at first Ewing paid him S7O a case for the whisky, but the price later dropped to S6O and then to SSO. * N. F. Wright, Negro, told of buying “red liquor” from Ewing. “It was pretty good liquor wasn’t it?,’’ Judge Baltzell asked. “Just Fair” Liquor ’Well,” and Wright hesitated noticeably, “just fair,” he said. He testified that he paid $4 or $5 a pint for the whisky. Defense of Osthimer and Ewing was made up of statements of character witnesses and the testimony of the men in their own defense. Other witnesses for the Government were I.oebl, Police Lieutenant George L. Winkler, United Statess Marshal Linus P. Meredith and A. J. Signaigo, Department of Justice examiner. Meredith told of the liquor being brought to Indianapolis from the Squibb distillery at Lawrenceburg, Ind., and being stored in the basement and on the second floor of the Government building. He related that locks on the basement room doors were tampered with and that he replaced them and also boarded up the windows and doo-s. Tells of Counts Signaigo told the court of two counts made by him and Meredith. One was on March 26, 1926, when the second floor room, according to the check, contained 504 cases and the basement room 619. He said another check, made April 15, revealed the same number of cases upstairs, but only 609 in the basement. Loebl said he was assigned to the case April 23, and learned the liquor could be stolen by removing pins from the door hinges and letting the door swing on the locks.
