CRUELTY, MURDER IN PRISON MINES ’ SHOCKSALABAMA Slavery May Be Abolished as Result of Grand Jury Disclosures. By E. T. Leech, Times Staff Corresvundent BIRMINGHAM, Ala., May 7. Juat aa the death of Martin Tabert, penniless boy Jailed for bumming a train ride, ended convict leasing in Florida, so the death of an almost unknown waif of the sea promises to accomplish that result in Alabama. And, if it does, prison slavery will have been wiped out of the United States. The most amazing story of prison cruelty in generations is coming to light here as a result of a grand Jury's investigation into the death of James Knox, a prisoner who died two years ago at the State convict mines at Flat Top, near Blrmlng ham. Six TnißcteiS Already six men have been in- * dieted for first degree murder, including the former warden and a deputy warden at Flat Top. Five of them are accused of murdering Knox. One of them participated In the alleged killing of a Negro convict and two or three more deaths being investigated. Confession has been made before the grand jury that Knox died while being ducked ip a vat of water, after he had been so terribly beaten in the coal mines that he had to be dragged to the surface. Mercury was then injected into bis stomach, the State charges, in an effort to Indicate suicide. More than a year after this man

died, the etory of another convict caused an autopsy over the body, and It was found that suicide was not the cause of death. Knox, who landetr at Mobile from a boat, had been convicted of forgery. Below normal height and weighing over 200 pounds, he claimed he whs physically unable to dig coal. But he was sent into the mines, arid It has been shown that he was rei>eatedly beaten and finally died while being punished In an effort to make him mine coal. The Investigation, however, got beyond the bounds of the Knox case and revealed a condition of prison barbarity that has sickened the State. Scores of convicts went before the Jurors and bared their scarred and broken bodies. The Jurors heard stories of men with broken arms and heads, shattered ribs and blinded eyes. The outcorAe has been a terrific blow, to Governor W. W. Brandon, who has steadfastly defended convict Iftislng because of the State's heavy profits from It and who cause Its continuance after It has once been voted out of existence by the Legis lature. The present expose is a result of the efforts of several Alabama news

papers which have steadfastly fought to end the system In the face of opposition from the Governor and certain large coal corporations. Two years ago the outcry became so sharp that the lease system was radically changed. Up to that time convicts had been leased bodily direct to coal companies. Since then the State has leased the mines and sold coal to the companies. The present Investigation has revealed, however, that this has actually made conditions worse. In the old lays injured convicts could and often did sue the coal companies. But under the new system they could not sue the State. IJfo Term Murderers Moreover. It has been shown that they worked under convict bosses, trusties who were almost always life term murderers. Convicts are paid for coal mined In excess of a certain allotment.
