RaLING IS DUE SATURDAY ON SCHOOL AFFAIR Arguments Heard on Motions Against Site Mandate Suit. Saturday morning Judge Sidney S. Miller of Superior Court Three will rule on motions of Martin M, Hugg, school board attorney, against a mandate suit filed by the Indianapolis Public School Welfare Association, seeking to enjoin the board from disposing of the Thirty-Fourth St. site for the new Shortridge High School and erecting it on the FortySixth St. site. Arguments on both sides were completed Wednesday by Hugg for the board, and Merle N. A. Walker and William Bosson, for the school association. Bosson insisted that ground once condemned and purchased for a public school cannot be used for any other purpose. The school commissioners do not have the power to do as they please, he said, and they must first consider the pupils and patrons. Bosson declared the majority faction of the board is guilty of a constructive fraud. Declaring the majority faction elected “accidentally,” Bosson said any member of the board may be removed upon petition of ten residents showing reasonable grounds for such action. However, he said such procedure would be taken only as a last resort. “If the school patrons have no right in the selection of the site, they certainly have a right to bale the commissioners into court and have an investigation as to their conduct in office," Bosson asserted. The public is not bound by any acts of the majority faction, said Walker. Walker said the Shortridge site was not an issue in the last election, and that the public indorsement of the three majority faction members was not a ratification for anything they would do. Hugg, who opened arguments, called the persons striving to retain the old site as a “militant minority.” IMPROVES STATION Station WGBS, New Tork, has made extensive improvements in its apparatus.
