CANDIDATES TO SEEK COURT AID Two Would Make Secretary $ Accept Declarations. A friendly' suit will be brought soon in Marion Circuit Court to compel Secretary of State Frederick E. to accept declarations of candidacy from George W. Long and Clarence E. Custer, Columbus Democrats seeking the Bartholomew County judgeship. William E. Sparks of Connersville, Republican candidate for Fayette County judge, also is to bring suit. . Schortemeier has refused declarations from Long and Custer on the strength of an opinion from Attorney General Arthur L. Gilliom that' the incumbent, appointed by Governor Jackson to fill a vacancy caused by death, must serve out tilt unexpired term of his predecessor. The same situation prevails in Parke County. Sparks’ suit will involve constitutionality of a 1925 act providing that judges whose terms expire this fall shall bold office until Jan. 1, 1929. It will affect seven counties. PROTEST BANK PETITION East Chicago Trust Company Seeks to Incorporate. Considerable opposition was voiced Wednesday by a group of Lake C,ounty bankers when the State board considered a petition Ms the'Guaranty Trust and Savings "tiank of East Chicago to incorporate. State Representative Willis E. Roe of East Chicago, chairman of the directors of the proposed bank, appeared in behalf of the petition. Representatives of a clearing house opposed the project. SEEK HOUSE PADLOCKS Two Suits Filed Alleging Liquor Law Violations. > Two more suits to close residences as public nuisances, following alleged liquor law violations, were filed in Superior Courts today. Deputy Prosecutor Paul Rhoadarmer and J. Carl Vandivier filed complaint against William Dilley, 309 X. Xoble St., and property owners, the Thomas D. McGee Company. Other suit was filed by Jess E. Martin and E. A. Miles, attorneys for the Anti-Saloon League, against William Gwj/nn and Kate Milton, who reside at 313 X. Cincinnati St., and Albert D. and Mary O. Moore, property owners. DAYTON, OHIO MAN HELD Walter Ross, Dayton, Ohio, held on automobile theft charges, was brought here today by Deputy United States Marshal J. 11. Wagner, anti held in the Marion County jail, pending arraignment. It is that he transported a stolen auto from Lpuisville to Seymour, Ind.

Collins told eleven women of the Tenth Ward Republican Club who visited Criminal Court today during the trial of Roosevelt Hicks, 23,. Negro, on a first degree murder charge. "There isn’t a better conducted court in the United States than your own Marion Criminal Court,” asserted Judge Collins. IMPROVEMENT ORDERED State Tax Hoard Authorizes Hoad Bond Issue. * The State tax board today authorized Marion County commissioners to receive bids for the Improvement of the Elmer Dawson Rd. between Kessler Blvd. and Keystone Ave. A remonstrance against the improvement was filed last July 29 by thirty-six Washington Township property owners, who claimed the improvement would not be of general utility value to residents of that township. A hearing was held last Aug. 24 and taken under advisement. Original figure for the bond issue was put at $51,500.

911.5 MILES ON ROAD SYSTEM State Additions Approved by Governor. State highway commission today was completing plans for the addition of 911.5 miles to the State highway system. Additions to the system were approved by Governor Ed Jackson at a conference with the commission Wednesday. With additional roads the State road system will total 5.039.5 miles. CITY PLANT STUDIED Sewage Methods to Be Used in Japanese Capitol. From distant Tokio came L. Kara, city sanitary engineer of the Japanese capitol, to view the sewage disposal plant and garbage system of Indianapolis Wednesday. Kara told George G. Schmidt, city engineer, and assistant, Edward Hauffler, who accompanied him on a tour of the system, that he planned to adopt many of its features in Tokio, which is recovering rapidly from the earthquake disaster. NO VERDICT REACHED Jury Discharged in Damage Suit Against City, Special Judge U. Z. Wiley of Superior Court Five today discharged the jury which heard the case of William Nackenhorst, president Fountain Square State Bank, who is seeking $20,000 damages against the city, after it reported a verdict could not be reached. Nackenhorst sought damages tor the loss of his daughter, who died from of an infection to her ankle which was injured during a basketball game in Tomlinson Hall when -the bleachers collapsed. No date for a second, trial was set. BUILDING FIRM SUED North Carolina Hoad Body and Indiana Company Plaintiffs. Suit for $20,000 damages was filed in Federal Court today by the North Carolina state highway commission and the Vincennes Bridge rompany against the Pensacola Ship Building Company and the Maryland Casualty Company, Baltimore, Md. Complaint alleges that the ship building company agreed to erect a bridge over Roanoke River, Halifax County, North Carolina and bought steel from the Indiana firm, but refused to pay the full amount for it.

TWENTY ARE INDICTED Twenty indictments were returned today by the Marion County grand Jury. Defendants and charges faced are: Henry Smith, George Peters, and Joh’n Phitlippe, conspiracy to commit petit larceny; Virgil Hart and Vinton Hines, forgery; Henry C. White, Walter Carmichael, conspiracy to commit grand larceny; Grover Morgan, burglary; John Taylor, robbery; Thomas Moore, vehicle taking. Defendants on ten indictments were marked as fugitives. KNOX JU DGE IN RACE William C. Pentecost of Knox, judge of the Starke-Pulaski Circuit Court, is being backed by up-State Republicans as a candidate for judge of the Indiana Appellate Court to succeed Judge Alonzo L. Nichols nf Winchester. Nichols’ term of office ends Jan. 1,-1027.

EX-STATE COP TAKEN TO HAM Howard Bennett Begins Liquor Bribe Term. Howard Bennett of Columbus, Ohio, former Indiana State policeman, found guilty Tuesday by Criminal Judge James A. Collins on charge of compounding a telony, was taken to the Indiana State Farm today to a six months’ sentence. Bennett, alleged to have accepted a SIOO bribe from Fred Slater, selfconfessed boo,tiegger, for promising immunity from arrest, said he would appeal to the State Supreme Court. Judge Collins fixed the appeal bond at $1,500. > Ira M. Holmes, defense attorney, hopes to procure bond at Columbus. Ohio. During the trial Bennett denied all of the charges. He was taken to the penal Institution in a truck with thirteen other prisoners, guarded by Deputy Sheriffs Charles Bell and Robert Reams. Bennett was former housekeeper for D. C. Stephenson, ex-Klan leader, who now Is serving a life term at the Indiana State Prison on a charge of murdering Miss Madge Oberholtzer.

REALTORS URGE WATER CASE AID Board Asks Governor to Consider Matter. Indianapolis Real Estate Board today urged securing of available legal talent to assist attorneys for the public in presenting the Indianapolis water Company case pending before the United States Supreme Court in a resolution adopted at the Chamber of Commerce. The l*>ard urged Governor' Jackson to give the matter prompt and careful consideration, so such assistance might be furnished at once. Public service commission and the city appealed the decision of Federal Judge Ferdinand A. Geiger on valuation of the company property in 1924. Georgb T. Whelden was appointed chairman .of the spring opening committeo to succeed L. L. Lewis, resigned. Emsley W. Johnson, paidc board president, spoke on "Parks and Recreation.”

Bii Time* Special MEXICO CITY, Mareh 18.—Rex Mcllpone, an American, was killed by Mexican bandits on the night of March 14, near the town of Ixtlan, in the State of Nayarit, according to a message rceeived at the American embassy here fronj the consul in Mazatlan. Another foreigner, E. Ileidenkamp, it is not stated whether he is an American, was ■wounded by the bandit.%
