DRUNK, HE GIVES UP ON ANCIENT fIURPER CHARGE Georgia Man Surrenders After Half Century of Freedom. Bv Unit-id Press MII.LEDGEVILLE, Ga.. Jan. 28. —Elated at the conviction tha.t he has but a few more years to live, Uncle Asa Patterson, 79, has started a long-delayed life sentence at the Georgia State Prison here for a murder committed during a game of cards 45 years ago. But for the fact that he took “too many drinks” on Christmas Eve, Uncle Asa would not be contemplating a prison-walled future today. The whiskey made him careless, he says, and caused him to climb into his flivver to visit his son in Pickens County, scene of the murder of Bob Simmons in March, 1881. Is Arrested Having drunk too much, the old man drove his car recklessly and police on searching it found several pints of whiskey. Thinking he had be£n krrested for the murder of Simmons, Uncle Asa freely told of his escape on the day he was sentenced and how for forty-five years he had cheated justice in a lonely Tennesse mountain retreat, whither he fled. k Shortly after his escape to the Tennessee mountain town, Uncle Asa’s first wife died, and he married again and reared a family of ten children. During all this, time, the son by his first marriage, now a prosperous merchant, was entirely ignorant of the old man’s whereabouts. Thisj son is doing everything in his power obtain a pardon. But Uncle Asa himself harbors no bitterness at his capture, nor does he manifest the slighest trace of remorse for the murder of Simmons. In fact he tells with a great deal of pride of the days when men drank hard corn liquor, gambled all night long and fought with knives or fists on the slightest provocation. Bu United Press _ PHILADELPHIA, Pa., Jan. 28. David L. Marshall, confessed slayer of his sweetheart, lies on a cot in the hospital at Moyamensing prison today, a nervous and physical wreck with a special guard near him to thwart a threatened attempt at selfdestruction.

As I was leaving,' Squire Simmons fired at me, the bullet passing through my hat. I lunged at them all, with nothing but my knife, and Squire’s knife eaught me in the leg, going through the bone. “I fell, and I suppose they thought I was killed for they ran away. Bob Simmons came back just as I was getting to my feet and we fought it out with knives. Bob still had his knife gripped in his right hand when he was found dead the next morning. Self-Defense “I have never been sorry for a minute that I killed him. I was justified and I know it. Three of them attacked me and I fought in self-defense. Any man would have done the same. "When they put me in jail and sentenced me to serve for life, my friends wanted to tear down the Jail. But I wouldn’t let them. I told them I would get out alone, and I did and
