PARTS DEALER FILES RRIEF TO SECURE MOREY Balance of Deposit in Highway Affair and Interest Asked. A plea that the State treasurer repay Otto F. Schlensker, auto parts dealer, the balance of $50,000 which he deposited In “pood faith” in the State treasury pending on investigation of his dealing’s with the State highway commission, is made in briefs filed before the five judges of the Marion County Court of Claims by Homer Elliott, Schlensker’s attorney. Elliott asked that not only the balance but also interest of approximately $4,000 be returned. "The State has had this money and has collected depository interest thereon. The State should not be permitted to enrich itself by the transaction,” Elliott contended. Schlensker is seeking the return of part of the money which he insisted Lawrence F. Orr, State examiner, accept when it was reported Irregularities had resulted in Schleneker’s dealing with the highway commission. It was alleged he had overcharged the State for auto parts. Evidence in the case was heard Jan. 4 by the Court of Claims. At that time it was disclosed by State examiners that Schlensker owed the State $51,309.44. According to the State’s contention, this would leave a balance of $1,309.44 yet unpaid. However, Elliott, while admitting his client owed the State between SB,OOO and SIO,OOO, denied any other Indebtedness.-'Elliott also stated the State claim was settled and that On had no authority to settle any account with Schlensker. Monday morning the court will hear oral arguments after which the judges will render judgment. Both parties have requested a special finding of fact, said Judge Sidney S. Miller, presiding judge.
